Decentralization of land use right certificate issuance to communes: "Unlocking" land procedures

According to the provisions of Clause 1, Article 5 of Decree No. 151/2025/ND-CP (Decree No. 151), from July 1, 2025, the Chairman of the Commune People's Committee will have the authority to issue land use right certificates (red books) to domestic individuals, Vietnamese people residing abroad who are Vietnamese citizens and residential communities.

This regulation is expected to create a breakthrough in shortening the time for processing records and simplifying the process, bringing maximum convenience to people.

Recorded at the Tan Lap Ward Public Administration Service Center on the morning of July 3 (the third day of the two-level local government officially operating after the merger), the working atmosphere was extremely exciting. Many people came here to do procedures related to the land sector. The good news is that all were enthusiastically and thoughtfully guided by the Center's staff on the process of submitting documents.

At the land records reception gate, there are two staff members always on duty to support the people. After being carefully checked by the staff, the people's records and documents will be received and a clear and transparent appointment paper will be issued. The professionalism and dedication of the staff has made a good impression on the people right from the first days of implementing the new regulations.

Mr. Tran Dinh Dong (residential group 6, Tan Lap ward) is one of the residents who have experienced this convenience. His family has nearly 600 square meters of land for perennial crops in Hoa Thang commune (old Buon Ma Thuot city) and wants to convert the land use purpose to residential land for housing. "This morning, when I came to do the procedures at the Tan Lap ward Public Administration Service Center, I was enthusiastically guided by the staff here. After only 20 minutes, all my documents were received and I had an appointment letter. It was really fast and convenient," Mr. Dong shared.

Similarly, at the Dray Bhăng Commune Public Administration Service Center, many people have come to carry out administrative procedures, especially in the field of land. From July 1 to the morning of July 3, the Commune People's Committee has received 7 dossiers related to land. The procedures for receiving and processing dossiers are all carried out in accordance with the law, ensuring publicity and transparency.

Mr. Trinh Van Minh (Hiep Tan village, Dray Bhang commune) could not hide his excitement when he came to do the procedures for the red book for the first time. He expressed his satisfaction when the staff guided him step by step during the implementation process. “In the past, every time I did procedures related to land, I was often afraid of the cumbersome process, complicated paperwork and having to go back and forth many times. However, now, thanks to being resolved right at the commune level, the procedures have become simpler, more convenient and the processing time has also been significantly shortened,” said Mr. Minh.

Ms. Nguyen Thi Le Quyen, a resident of Ea Ktur commune, also shared the same opinion. After the administrative boundary merger, her family now lives in the area bordering Dray Bhăng commune. To complete the procedures for transferring land use rights to her children, she went to the Dray Bhăng Commune Public Administration Service Center. Here, she was guided in detail by the staff, from getting a queue number to each step of carrying out the procedures at the transaction offices. "This decentralization not only helps shorten the processing time, but also creates more favorable conditions for people in the process of handling documents, significantly reducing time and travel effort," Ms. Quyen shared.

Mr. Huynh Thanh Trung, an expert at the Tan Lap Ward Public Administration Service Center, said that according to the new regulations, the People's Committee at the commune level is allowed to carry out 14 procedures related to the land sector. In the first 3 days of operation, the Center received and processed about 20 sets of documents related to the land sector for the people. In particular, the main ones were applications for the first issuance of red books and documents for changing land use purposes. In addition, many citizens also came to the Center to be guided on the necessary procedures related to transfer and adjustment, and all were enthusiastically guided by the staff.

Deputy Secretary of the Party Committee and Chairman of the People's Committee of Dray Bhang Commune, Le Phuoc Toan, said that the Public Administration Service Center of the commune is located in a convenient location, and the facilities and machinery have been invested in a spacious and complete manner in advance. This helps the Center meet the requirements of serving the people according to regulations and effectively implement tasks right from the time the two-level local government model officially came into operation.

In the first days of operation, although the Commune People's Committee had not yet received the seal from the competent authority, the Center still maintained the normal operation of receiving documents. For administrative procedures with a short processing time, the staff directly guided and explained the initial processing process to the people. At the same time, they requested to provide contact information to proactively notify the results as soon as the seal was handed over. Mr. Toan affirmed: "With the spirit of serving the people best, the Commune People's Committee will strive to overcome the initial difficulties, ensuring that the process of receiving and handling administrative procedures takes place smoothly and continuously, without interruption."

Regarding this issue, on July 2, the Provincial People's Committee issued an official dispatch on the implementation of administrative procedures according to the provisions of Decree No. 151 of the Government. Accordingly, the Provincial People's Committee assigned the Commune People's Committee to coordinate with the Department of Agriculture and Environment, the branch of the land registration office in the locality to advise on internal and internal interconnected procedures in handling administrative procedures in the land sector under the authority of the Commune People's Committee and the Chairman of the Commune People's Committee. Organize the implementation of the provisions of the law on land, especially Decree No. 151 on decentralization and delegation in the land sector to promptly grasp new points on the authority and procedures for handling administrative procedures in the land sector in the locality, ensuring synchronization, timeliness, smoothness, continuity and no interruption.
