From July 1, the Chairman of the People's Committee at the commune and ward level will directly sign and issue red books.

According to Decree No. 151/2025/ND-CP of the Government regulating the decentralization of authority of local authorities at two levels, decentralization and decentralization in the field of land, from July 1, the settlement of procedures for the first issuance of red books will be carried out at the commune level. The Chairman of the People's Committee at the commune and ward level will be the person who directly signs to issue red books in cases that meet the prescribed conditions.

Providing specific information about the new point above, Deputy Director of the Department of Land Management ( Ministry of Agriculture and Environment ) Mai Van Phan emphasized that Decree No. 151/2025/ND-CP is an important legal foundation to promote decentralization, delegation and transfer of authority in accordance with practical conditions at the grassroots level. In particular, one of the outstanding contents of this decree is to fundamentally change the process of granting red books for the first time to create maximum convenience for people.

Accordingly, the authority to handle procedures for granting red books for the first time to domestic individuals, Vietnamese people residing abroad who are Vietnamese citizens and communities will be transferred from the district level to the commune, ward and special zone levels.

“Compared to before, the first issuance of a red book usually had to go through at least two levels, but now the process will be shortened and carried out at only one level, the commune and ward level. This not only helps reduce time and costs, but also creates maximum convenience for people when carrying out land procedures,” Mr. Phan emphasized.

According to Mr. Phan, transferring the authority to issue red books from the district-level People's Committee to the chairmen of the commune-level People's Committee is an important step in the roadmap to build a serving government. This is also a concrete manifestation of the spirit of administrative reform, focusing on the grassroots level, making public agencies become "extended arms" to each person and household.

To ensure feasibility in the decentralization process, the decree also synchronously designed related contents such as: Clearly defining the policy-making function of the Central Government and the implementation function of localities; linking the transfer of authority with specific conditions on human resources, budget, and database at the grassroots level; clearly defining the authority between the People's Council, People's Committee and Chairman of the People's Committee at all levels in the direction of shifting from "general authority" to "specific authority."

According to the process, people who need to be granted a red book for the first time will submit an application for a certificate at the place where the application is received according to regulations. The commune-level land management agency will base on specific cases and related policies to resolve such as: Classifying whether there are documents on land use rights or not, whether there are violations or the land is allocated beyond the authority prescribed in Articles 137, 130, 139, 140 of the Land Law to resolve.

However, the Deputy Director of the Department of Land Management also noted that people need to clearly distinguish between the land registration process and the red book issuance procedure as prescribed in Decree 151/2025/ND-CP.

Specifically, land registration is a mandatory requirement for those who are using land or those who are assigned land by the State for management. "This is to establish the State's land management records and at the same time verify the current land use status of organizations and individuals. On that basis, when there is a need to issue a red book, the land user must fulfill financial obligations according to regulations, as determined by the tax authority.

"Currently, the time to resolve financial obligations has been shortened to 17 days. After completing financial obligations, the commune-level People's Committee will carry out the procedure to issue the first red book within 3 days," Mr. Phan said./.
