The Law on Cadres and Civil Servants 2025 takes effect from July 1, 2025. The Law closely follows the Party's policies on cadre work, especially Resolutions No. 57-NQ/TW, No. 59-NQ/TW, No. 66-NQ/TW and No. 68-NQ/TW of the Politburo, demonstrating innovative thinking, creating a synchronous legal corridor for civil servant management in a dynamic, transparent and effective manner, meeting the requirements of the task in order to build a team of professional cadres and civil servants, serving well the cause of socio-economic development and the needs of people and businesses.

Based on the provisions of the Law, the Government is assigned to provide detailed regulations. The Government has directed the Ministry of Home Affairs to preside over and coordinate with relevant agencies to develop decrees guiding the Law.

On June 30, the Government issued four decrees that will take effect in sync with the Law from July 1, 2025, regulating the recruitment, use and management of civil servants; training and fostering of civil servants; disciplinary action against cadres, civil servants and contracts for the performance of civil servant duties.

Innovation in civil servant management methods according to job positions

Mr. Nguyen Quang Dung, Director of the Department of Civil Servants and Public Employees (Ministry of Home Affairs), said that Decree No. 170/2025/ND-CP regulating the recruitment, use and management of civil servants consists of 6 chapters and 73 articles, replacing Decree No. 138/2020/ND-CP regulating the recruitment, use and management of civil servants (amended and supplemented in Decree No. 116/2024/ND-CP), Decree No. 46/2010/ND-CP regulating termination and retirement procedures for civil servants and Decree No. 06/2023/ND-CP regulating the quality assessment of civil servant input.

This Decree details the innovative contents of the Law on unified management of civil servants from the central to communal levels; innovates the method of managing civil servants according to job positions, taking job positions as the center, on the basis of the requirements of job positions and results and products of performing tasks to recruit, arrange, use, plan and appoint.

The Decree specifically stipulates the conditions, standards, documents, contents, forms, procedures for examination, selection, and admission to civil service positions suitable for each job position with professional and technical ranks, especially the admission to leadership and management positions for high-quality human resources; stipulates the arrangement and assignment of work to ensure consistency between the authority and assigned tasks associated with the job position; and the responsibility of the head of the agency using civil servants to arrange and assign work in accordance with the requirements of the job position.

According to Decree 170, cases of changing job positions are assigned a corresponding rank different from the current rank; decentralization in civil servant management is promoted, administrative procedures are reduced such as eliminating exams for promotion; there is no regulation on unified quality assessment of civil servant input at the national level.

Promote the responsibility of civil servants

Decree No. 171/2025/ND-CP regulates the training and fostering of civil servants with 7 chapters and 42 articles, replacing Decree No. 101/2017/ND-CP (amended and supplemented in Decree No. 89/2021/ND-CP).

According to Mr. Nguyen Quang Dung, the new point in the Decree is the regulation on training and fostering civil servants according to the principle of managing civil servants according to job positions, linking training and fostering work with the work of using, appointing and managing civil servants.

Promote the responsibility of civil servants in self-study, learning and choosing training programs according to the requirements of their job positions; promote the assignment and decentralization of training and development of civil servants according to job positions in accordance with the functions and tasks of training and development facilities at the central and local levels and state management agencies at all levels.

At the same time, the Decree stipulates the enhancement of the application of science and technology and digital transformation in training and fostering; abolishing training according to civil servant rank standards. Civil servants in leadership and management positions must participate in training in state management knowledge and skills after being appointed.

Regarding Decree No. 172/2025/ND-CP regulating disciplinary actions against cadres and civil servants, the Director of the Department of Civil Servants and Public Employees said that the disciplinary form of demotion for leading and managing civil servants and the form of salary reduction for civil servants not holding leadership and management positions have been eliminated; ensuring consistency and uniformity between Party discipline regulations and administrative discipline, and consistency with the use of civil servant assessment results according to new provisions of the Law.

In addition, the Decree supplements specific provisions on cases of exclusion, exemption from discipline or reduction or increase of discipline level to institutionalize Regulation No. 69-QD/TW of the Politburo on discipline of Party organizations and Party members who violate the law (amended and supplemented in Regulation No. 264-QD/TW), Regulation No. 296-QD/TW of the 13th Party Central Committee on inspection, supervision and discipline of the Party. The Decree consists of 5 chapters and 30 articles, replacing the provisions on disciplinary action against cadres and civil servants in Decree No. 112/2020/ND-CP on disciplinary action against cadres, civil servants and public employees (amended and supplemented in Decree No. 71/2023/ND-CP).

Attracting high quality human resources

Regarding Decree No. 173/2025/ND-CP on contracts for performing civil servant duties, Mr. Nguyen Quang Dung said that this is a new mechanism stipulated in the Law on Cadres and Civil Servants to attract high-quality human resources with a lot of experience and intelligence, meeting the requirements and tasks, and improving the effectiveness and efficiency of state agencies.

The Decree stipulates the signing of labor contracts and service contracts to perform one or several tasks of civil servants, especially signing contracts with managers, business administrators, outstanding and outstanding businessmen, good lawyers, experts, and leading scientists to perform one or several tasks of strategic, sudden, and urgent leadership and management positions; signing service contracts to perform administrative tasks or tasks that the current human resources cannot meet.

“The cost of implementing the contract signing is allocated by the state budget at a maximum of 10% of the total salary fund (including salary and salary allowances) and bonuses, outside the salary fund, outside the administrative expenditure budget according to the payroll of the agency, organization, unit and is estimated in the annual budget,” Mr. Dung informed.

Decree No. 173/2025/ND-CP consists of 3 chapters and 16 articles.

"The promulgation of the Law on Cadres and Civil Servants and guiding decrees is an important step to concretize the Party's major policies and orientations on cadre work and civil service regime, especially institutionalizing breakthrough resolutions affirmed as the 'Four Pillars' of national development, into practice effectively, contributing to building a modern, professional Vietnamese civil service, operating for the country's development and serving the people," said Director Nguyen Quang Dung./.
