“Digital birth certificate” for works of art

Faced with the current problems and challenges of copyrighting works of art, SGGP Newspaper reporter had a conversation with Ms. Le Minh Hang, Director of the Center for Law & Copyright (under the Vietnam Reproduction Rights Association - VIETRRO) about identifying works of art by NFT (a type of digital asset stored on blockchain), creating a "digital birth certificate", opening up a new direction in combating piracy and counterfeiting of works.

* REPORTER: VIETRRO has just launched the digital platform Vietcopyright.com. In your opinion, what is new and special about this platform in protecting copyright of artistic works?

* Ms. LE MINH HANG: Vietcopyright.com is currently the only platform in Vietnam that applies blockchain technology in identifying and managing copyrights. The platform is developed by VIETRRO - the only collective copyright and related rights organization (CMO) with the function of protecting copy rights in Vietnam.

The difference of Vietcopyright lies in its authenticity, transparency and connectivity. This platform not only provides a unique NFT identifier for each work, but also records all original information on the blockchain, helping to authenticate ownership right from the moment of creation, both in digital and physical environments. Unlike previous solutions that often stop at manual registration or paper certification, Vietcopyright.com deploys a comprehensive digitalization process: from registration, authentication, management to work retrieval, licensing of copies, buying and selling works, all are done online, transparently and have legal value.

In addition, the platform integrates the function of licensing and commercializing works operated by VIETRRO, supporting authors to control the use of copies, track the flow of royalties and keep track of transactions. This is an important step forward, contributing to promoting the professionalization of intellectual property management and the development of the creative industry in Vietnam.

* By participating in WIPO Connect, how will creative works such as paintings, art photos, poems, etc. be assigned international identification codes?

* When connected to WIPO Connect, each collective management organization (CMO) will have its own international identifier, standardized by WIPO. VIETRRO's identifier is 2060. This helps distinguish between hundreds of different CMOs operating globally. When an author authorizes a work and registers with VIETRRO, the author will have an identifier according to VIETRRO's code.

This helps the work to be recognized globally. Authors can easily prove ownership in case of dispute, increase access to international markets, enhance the reputation and value of the work, and transparently monitor the use of the work thanks to the bilateral cooperation mechanism between CMOs. Collectors or organizations using the work can check the origin and copyright status before purchasing, licensing or using it commercially.

* In case of risk, what plans and solutions will VIETRRO have to ensure copyright?

* When a work is identified on Vietcopyright.com, the author will be established digital ownership through a unique NFT code, combined with immutable information storage on the blockchain. This data is also entered into the WIPO Connect system, helping to confirm ownership not only domestically but also internationally. The work is managed in VIETRRO's collective copyright system, thereby having full legal grounds to intervene in case of infringement.

In case of risks such as illegal copying, unauthorized use or ownership disputes, VIETRRO will act as a representative to handle complaints, collect evidence from the system to support authors in filing lawsuits or requesting handling of violations. With a multi-layered protection mechanism, combining technology, domestic law and international recognition, Vietcopyright.com is not only a technical tool but also a solid legal barrier for authors and collectors in the process of creating and trading works.

* By identifying works with NFT codes, do you think it will be possible to prevent fake and copied paintings - a rather headache problem for the domestic art community today?

* Preventing counterfeit and copied paintings is the responsibility of the whole society. Although identifying works with NFT codes cannot completely prevent counterfeiting or copying, it is a very effective tool to authenticate the originality and trace the origin of works - which is a big problem in the current art market. NFTs cannot stop counterfeiters, but will make it difficult for fake paintings to "survive" - ​​because buyers and the market can clearly distinguish between identified original works and unauthentic fake copies. This could be an important step forward to help professionalize the art market in the digital age.

An important issue in limiting, and even contributing to eliminating the problem of fake and copied paintings, is the licensing of copies. A person who needs to use a copy can, through Vietcopyright, apply for a license to use it for different purposes at a suitable price, which will reduce the demand for buying fake and copied paintings. Because they can use a legal copy for the same price and the author also receives the desired amount of money, so the purchase of fake and copied paintings will automatically disappear, just like the problem of pirated discs in the previous decade.

The process of identifying works on the Vietcopyright.com platform is completely digitalized with 3 steps: the author or owner registers an account and identifies the work in digital form (photos, paintings, documentary photos, etc.); each work after being identified will be assigned a unique NFT code, recording all information such as work name, author, creation time, ownership, etc.; the identified work will be stored in a centralized copyright management database, helping to establish ownership in a transparent manner and can be retrieved at any time.
