Defendant Le Minh Chau
According to the indictment, around April 2020, Chau saw Mr. Nguyen Tan Phung, also residing in Tan Hiep commune, selling a plot of land for perennial crops, so Chau agreed to transfer the right to use the above plot of land for 1.45 billion VND.
However, Chau did not have enough money to transfer, so he verbally agreed with Mr. Phung to pay 640 million VND in advance and give Chau the land to use; the remaining 810 million VND. Chau asked Mr. Phung to complete the name change procedure so that Chau could mortgage it to the bank and then pay the remaining amount.
After completing the transfer procedure to Chau, Mr. Phung repeatedly asked to pay the remaining amount but Chau did not have the money to pay as agreed. To gain Mr. Phung's trust, Chau went online to order a fake land use right certificate for 10 million VND and gave it to Mr. Phung to keep.
Chau told Mr. Phung that when he paid the full amount, he would get back the land use right certificate, but in fact, Chau had already pawned the land and documents. Mr. Phung thought the documents were real, so he kept them and did not ask Chau for the debt anymore.
Around the beginning of 2022, Mr. Phung took Chau's land use right certificate to the Land Registration Office for inspection and discovered it was fake. Mr. Phung filed a complaint against Chau with the police.
