Many efforts but still facing difficulties
According to the report of the Department of Agriculture and Environment (DARD), for the list of 15 land plots collecting land use fees and land rent in 2025 according to Plan No. 494, dated March 14, 2025 of the DARD, up to now, 5 projects have been submitted to the Land Valuation Council, including: Cam Ranh Bay Urban Area, An Binh Tan Urban Area, Green Hill Villa Area, Apartment Building No. 04 Nguyen Thien Thuat, Champarama Resort & Spa Vinh Hoa Nha Trang Project; 4 projects have signed contracts and the consulting unit is implementing. The difficulty encountered is that there are 6 projects that have signed contracts but the consulting unit refused to continue participating, so it is necessary to hire another consulting unit. Currently, the DARD has hired new consulting units for 3 projects; 3 projects that have not hired other consulting units include: Le Hong Phong II Urban Area (adjusted planning), Hung Thinh Urban Area, Area 39-41 Nguyen Thi Minh Khai. With the list of land lots and land plots auctioned for land use rights in 2025 issued under Plan No. 5342, dated May 6, 2025 of the Provincial People's Committee, there are 9 land lots that are not eligible for auction because they are in the process of completing detailed planning at a scale of 1/500.

For 11 projects mentioned in Resolution No. 170, dated November 30, 2024 of the National Assembly on specific mechanisms and policies to remove difficulties and obstacles for projects and land in the inspection, examination and judgment conclusions in Ho Chi Minh City, Da Nang City and Khanh Hoa Province, the Department of Agriculture and Environment has actively implemented the procedures for selecting land price determination units (approving cost estimates, approving contractor selection plans, inviting consulting units to study the documents in advance). Up to now, there is 1 project that has approved cost estimates, contractor selection plans and contractor selection results, which is the Hoang Phu Luxury Housing Project; The Arena Project has approved cost estimates. Recently, the Department of Agriculture and Environment has sent a document to departments, branches and sectors on coordinating the review of 11 projects to continue implementing and completing the documents; It is expected that the Land Valuation Council will appraise the land price plan before September 1, 2025.
Ensure proper implementation of legal procedures and regulations
In addition to the great efforts of the province, departments, branches, and localities in determining land prices and auctioning land use rights for projects, there are still shortcomings and limitations that the provincial authorities need to seriously acknowledge and learn from. According to the report of the Department of Agriculture and Environment, through reviewing and reconsidering the entire process of determining, appraising, and approving specific land prices for 3 projects: Le Hong Phong II Urban Area, Napoleon Castle Apartment, Phuoc Long New Urban Area, the approved land prices are applied according to the provisions of Decree No. 12, dated February 5, 2024 of the Government amending and supplementing a number of articles of Decree No. 44, dated May 15, 2014 of the Government regulating land prices and Decree No. 10, dated April 3, 2023 of the Government amending and supplementing a number of articles of the decrees guiding the implementation of the Land Law. However, all 3 land price options approved by the Provincial People's Committee for the 3 above-mentioned projects do not apply the correct procedures and contents of legal documents in Decree No. 71 dated June 27, 2024 of the Government regulating land prices effective from August 1, 2024 (amending and supplementing a number of articles in Decree No. 12), leading to investors' complaints. To resolve the problems of the 3 above-mentioned projects, up to now, 1 project has signed a contract with a consulting unit to re-determine land prices; 1 project will re-hire a consulting unit to determine land prices; 1 project, the Department of Agriculture and Environment is proposing the province to cancel the old approved land price decision to implement specific land price determination in accordance with current legal regulations.
To speed up the progress of land use rights auction for 9 land plots that are not eligible for auction because the detailed planning at scale 1/500 is in the process of being completed, the Department of Agriculture and Environment has proposed that the Provincial People's Committee direct the Provincial Land Fund Development Center and localities to complete the dossiers so that the land plots and land plots are eligible for auction; the units assigned to manage the auctioned land fund report the progress of implementation and problems (if any) to the Department of Agriculture and Environment before the 20th of each month.
At the meeting to listen to the leaders of relevant departments, branches and units report on the situation and results of the implementation of land use rights auctions, determining financial obligations for a number of projects that have allocated land and leased land in June 2025, the leaders of the Provincial People's Committee assigned the Department of Agriculture and Environment to preside over and coordinate with departments, branches, units and localities to urgently review, complete and supplement the dossiers of land plots and land plots to meet the conditions for auction in accordance with the provisions of law. For the 11 projects mentioned in Resolution No. 170 of the National Assembly, the Department of Agriculture and Environment coordinated with departments and branches to conduct field inspections of the projects, complete the dossiers to submit to the Provincial People's Committee, the Land Valuation Council for land price plans; the process of completing dossiers, auctioning land use rights, determining land prices, and determining financial obligations at the projects requires close coordination, assigning responsibilities to each department, branch and unit to create positive changes and high efficiency; in accordance with current legal procedures and regulations.

Currently, the Department of Agriculture and Environment has built a progress schedule for the construction of the Khanh Hoa province land price list in 2026 for implementation; signed a contract with Ecovis AFA Vietnam Auditing, Appraisal and Consulting Co., Ltd. (consulting unit) to implement the Project of Building the Khanh Hoa province land price list to be applied from January 1, 2026. By July 1, the consulting unit had compiled the results of the provincial investigation and survey and was reviewing to send a summary report to the Department of Agriculture and Environment for consideration and inspection before preparing a draft explanatory report and a draft land price list in 2026 to carry out the next steps.
