Tighten certification, professionalize real estate brokerage

Tools to contribute to a stable, healthy market

According to the report of the Vietnam Association of Realtors (VARS), 89% of real estate brokers currently do not have a practice certificate or their certificates have expired. Of these, 51.8% have never been trained, 24.1% have studied but have not been granted a certificate. Most of them practice as “amateurs”, lack legal knowledge, do not understand the market and have limited consulting skills, while this is the intermediary force that plays a decisive role in the transparency and stability of the real estate market.

In order to gradually overcome this situation, the 2023 Law on Real Estate Business has introduced many new regulations, tightening activities related to real estate brokerage. From August 1, 2024, individuals practicing the profession must have a real estate brokerage certificate and work in a real estate trading floor service business or a real estate brokerage service business. At the same time, businesses wishing to operate in the brokerage field must have at least one individual with a valid practice certificate.

From the perspective of a direct practitioner, Mr. Tran Hong Quan - an employee of Bezone Ha Tinh Real Estate Floor shared: "The requirement to have a practice certificate according to the law is absolutely necessary after a long period of spontaneous brokerage activities without management. Brokers need to have good knowledge, especially understanding of the law to provide correct advice and establish a legitimate professional role in society."

Early implementation of professional exams according to regulations

In Ha Tinh, recently, the Department of Construction has organized 2 rounds of exams to grant real estate practice certificates according to the provisions of the 2014 Law on Real Estate Business, through which 765 individuals were granted certificates.

However, for nearly a year now, due to difficulties in issuing documents guiding the implementation of the 2023 Law on Real Estate Business, many localities across the country, including Ha Tinh, have not organized professional exams as prescribed.

Mr. TVT (Thanh Sen Ward) said: "Although they have grasped the spirit of the new law, many individuals practicing the profession are having difficulty in legalizing procedures. The early organization of local certification exams is something that the brokerage community is very interested in and looking forward to."

Previously, the Ha Tinh Department of Construction organized two rounds of exams to grant real estate practice certificates according to the provisions of the 2014 Law on Real Estate Business, through which 765 individuals were granted certificates.

After a period of interruption due to waiting for implementation instructions, the examination and recognition of professional competence activities are being restarted. According to Article 26 of Decree 144/2025/ND-CP (issued on June 12, 2025), from July 1, 2025, the authority to organize professional examinations and issue practice certificates will be decentralized to local construction departments. Decentralization is expected to increase initiative, shorten administrative procedures and create favorable conditions for brokers and businesses.

As one of the units that have coordinated to organize the exam many times in Ha Tinh, VCB Group Corporation ( Hanoi City) hopes that from this regulation, localities will soon implement the real estate brokerage practice certificate exam, meeting the increasing demand for this field. Mr. Nguyen Quang Tu - General Director of the company shared: "With many years of experience in the real estate field, VCB has also prepared the related conditions, ready to coordinate closely with departments and branches to ensure the exam is organized in accordance with regulations, transparently and effectively".

Establishing professional standards and controlling the quality of brokerage teams is a necessary step to make the real estate market transparent.

Mr. Nguyen Tien Dung - Head of Housing and Real Estate Market Management Department (Ha Tinh Provincial Department of Construction) said: "The decentralization of authority to the local Department of Construction will help the professional assessment work to be more flexible, proactive, and to actual conditions. Currently, the Department is receiving documents through the National Public Service Portal and developing a plan to implement the professional assessment process in a public and transparent manner, ensuring compliance with appropriate legal regulations in the coming time".

To ensure that real estate brokerage activities in the area are carried out seriously and in accordance with the law, the Department of Construction strictly controls the procedures for recognized professional capacity; promoting propaganda and dissemination of new regulations in the 2023 Law on Real Estate Business and guiding documents for implementation. Publicly and transparently disclose information on the real estate market, including: planning, land use plans, list of real estate eligible for business, housing development programs... to help people, investors and businesses easily access official information sources. In addition, the Department will strengthen the inspection and supervision of the real estate market in the area to promptly correct, prevent and strictly handle violations within its authority.

It can be seen that establishing professional standards and enhancing quality control of the brokerage team are necessary steps to make the real estate market transparent. When this force is professionalized, the market will operate more stably, limit speculation, fraud and develop in a sustainable and healthy direction.
