A draft to create and develop highereducation
“I highly appreciate the Drafting Committee when developing this draft. The draft has clearly specified the policy of institutional innovation and current law-making in the direction of creation and development. This is truly a draft for creation and development of higher education. If promulgated in accordance with this spirit, the Law on Higher Education (amended) will open up a spacious space for the development of higher education” - sharing the above opinion when studying the draft Law, Dr. Pham Do Nhat Tien also gave some comments.
Specifically, regarding the scope of regulation, it is proposed to add the clause: "Organization and operation of higher education at the college level shall comply with the provisions of the Law on Vocational Education". The explanation of terms should include the concepts: "member university", "affiliated university", "digital higher education", "open higher education", "high-quality human resources".

The term “academic freedom” is also included in the explanation section. Expressing his appreciation, Dr. Pham Do Nhat Tien hopes to include a provision using this concept in the draft Law, reflecting the true spirit and ideology of development creation.
Emphasizing the issue of management, Dr. Pham Do Nhat Tien suggested that the content on diploma management should be included in the Law; along with that, the content on program and curriculum management. In addition, some regulations are unnecessarily detailed, such as regulations on schools, faculties, registration of educational activities, etc.
Commenting on the draft Law, Mr. Ho Xuan Nang, Phenikaa University, commented: Basically, this draft Law updates a lot of specialized content and adds new content. From the reality of higher education institutions, these are very practical and suitable amendments.
Regarding the innovative university model, Mr. Ho Xuan Nang proposed to add this content to the “scope of adjustment”. At the same time, if a university is associated with innovation, it must be understood as a special enterprise in science and technology. From there, regulations on the organizational structure of universities should be open so that universities can adjust according to the development situation and characteristics of the school…




Breakthrough regulations needed to help develop higher education
Speaking at the meeting, Mr. Le Huy Hoang, Deputy Director of the Department of Education, Central Propaganda and Mass Mobilization Commission, emphasized three factors for a university to develop: motivation, resources and capacity. Looking at the draft Law, it can be seen that the resource issues have been resolved quite a lot; but the two remaining issues have not really had a strong impact and need to be clarified further.
Giving specific comments on the draft, Mr. Le Huy Hoang proposed that some issues be regulated in the Law in a separate chapter, related to AI in higher education, non-profit private higher education; at the same time, there should be regulations related to the job positions of professors and associate professors to fully promote the role of this human resource.
Mr. Hoang Van Cuong, Vice Chairman of the State Council of Professors, said: The Law amending and supplementing a number of articles of the Law on Higher Education (Law No. 34) has created a breakthrough change related to the university autonomy mechanism. This time, the Law is amended comprehensively, certainly there must be a breakthrough, creating a qualitative change. We hope that when researching and collecting opinions to build the Law, we will point out what the breakthrough content is.

Regarding this issue, Mr. Hoang Van Cuong emphasized first of all the need to create a mechanism for universities to be able to take the lead, pioneer, and bring achievements into teaching and research. From that breakthrough, the second issue is that the autonomy of universities must be high. Without autonomy, without self-determination, it is impossible to take the lead, to be creative...
Taking note of and absorbing the comments, exchanging and discussing at the meeting, Deputy Minister Hoang Minh Son discussed the issues that received much attention. According to the Deputy Minister, thanks to university autonomy, the management capacity of schools has been significantly improved in recent years.
