The document was signed by Deputy Director of the Department of Agriculture and Environment of Ho Chi Minh City, Vo Trung Truc, and sent to the People's Committees of districts and Thu Duc City on June 30, before the day Ho Chi Minh City officially operated the 2-level local government model on July 1.
Accordingly, implementing Decree No. 151/2025/ND-CP dated June 12, 2025 of the Government on the decentralization of authority of local governments at 2 levels, decentralization, and decentralization in the field of land, the Department of Agriculture and Environment of Ho Chi Minh City requests that localities in Ho Chi Minh City from July 1 onwards, the People's Committees of communes and wards where the land is recovered will base on the origin, the process of creating and using houses and land to determine the subjects of compensation, support, and resettlement and base on the practical situation of each specific project to decide on other support measures and policies according to Clause 2, Article 108 of the 2024 Land Law for consideration and decision.

According to the Department of Agriculture and Environment, in Notice No. 429/TB-VP dated April 28 of the Office of the Ho Chi Minh City People's Committee conveying the direction and conclusion of Vice Chairman of the Ho Chi Minh City People's Committee Bui Xuan Cuong, the People's Committees of districts and Thu Duc City were assigned to carefully review the origin, process of land creation and use; accurately determine the subjects of compensation, support and resettlement according to the provisions of law.
On that basis, consider resolving cases of division, sale, and transfer of land use rights by handwritten documents and notarized documents during the period from July 1, 2014 to before the date of project implementation policy according to authority and legal regulations.
In case it is necessary to apply support policy measures as prescribed in Clause 2, Article 108 of the Land Law, the People's Committees of districts and Thu Duc City shall urgently report and propose to the Department for synthesis, appraisal and submission to the Ho Chi Minh City People's Committee for decision on each specific project as prescribed by law.
On May 19, the Office of the Ho Chi Minh City People's Committee continued to convey the direction and conclusion of Vice Chairman of the Ho Chi Minh City People's Committee Bui Xuan Cuong regarding cases of land use rights division, sale, and transfer by handwritten documents and notarized documents from July 1, 2014 to before the date of project implementation must be implemented in accordance with the direction of the Ho Chi Minh City People's Committee in Notice No. 429.
Next, on June 12, implementing the direction of the Chairman of the Ho Chi Minh City People's Committee on removing difficulties and obstacles in the disbursement of public investment capital for projects with compensation capital recorded in 2024 and 2025, the Department of Justice issued an official dispatch requesting the Chairman of the Ho Chi Minh City People's Committee to approve the following contents:
In the period before June 30, continue to assign the People's Committees of districts, towns, and the old Thu Duc City to carefully review the origin, process of land creation and use; accurately determine the subjects of compensation, support, and resettlement according to the provisions of law.
From July 1 onwards, the Chairman of the People's Committee at the commune level will be assigned to carefully review the origin, process of land creation and use; accurately determine the subjects of compensation, support and resettlement according to the provisions of law. The People's Committee at the commune level will base on the practical situation of each specific project to decide on other support measures and policies according to Clause 2, Article 108 of the Land Law, Clause 7, Article 12 and Clause 9, Article 13 of Decree No. 88/2024/ND-CP.
