The Ministry of Transport has just issued a document responding to a petition from voters in Ben Tre province requesting additional sanctions for crew members and vehicle drivers whose blood or breath contains alcohol or drugs.

Currently, there are only regulations on administrative penalties for the behavior of crew members and vehicle drivers on duty who have alcohol concentration in their blood or breath (Illustration photo).

Regarding this issue, according to the Ministry of Transport , Decree No. 139/2021 stipulates administrative sanctions for violations committed by crew members and vehicle drivers on duty with alcohol concentration in their blood or breath.

Specifically, a fine of 3 - 5 million VND will be imposed on crew members and vehicle drivers working on a vehicle whose blood or breath alcohol concentration does not exceed 50 milligrams/100 milliliters of blood or 0.25 milligrams/01 liter of breath.

Fines from 5 to 10 million VND for crew members and vehicle drivers working on a vehicle whose blood or breath alcohol concentration exceeds 50 milligrams to 80 milligrams/100 milliliters of blood or exceeds 0.25 milligrams to 0.4 milligrams/01 liter of breath.

Fines from 20 to 35 million VND for crew members and vehicle drivers working on a vehicle whose blood or breath alcohol concentration exceeds 80 milligrams/100 milliliters of blood or exceeds 0.4 milligrams/01 liter of breath.

In addition, the Decree also stipulates additional penalties for violations. Accordingly, the right to use certificates of professional competence and professional certificates will be revoked for 1-2 months or 2-4 months for violations of regulations.

Thus, Decree No. 139/2021 stipulates administrative sanctions for the acts of crew members and vehicle drivers on duty with alcohol concentration in their blood or breath.

However, there are no regulations on penalties for crew members or watercraft operators whose blood contains drugs, nor are there any regulations on additional penalties for temporary detention of vehicles for crew members or watercraft operators whose blood or breath contains alcohol or drugs.

The Ministry of Transport said that it has requested the Vietnam Inland Waterways Administration to review and research to propose amendments and supplements to behaviors and sanctions and continue to research during the review process, propose amendments and supplements to Decree No. 139/2021 to ensure compliance with legal regulations and practical situations.
