The Draft Law on Civil Aviation of Vietnam (LAVI) replacing LAVI No. 66/2006/QH11, amending and supplementing a number of articles in Law No. 61/2014/QH13 has just been sent by the Ministry of Construction to the Ministry of Justice for appraisal.
According to the draft, the Ministry of Construction will manage aviation safety while the Ministry of Public Security will preside over aviation security issues. The Minister of Construction is given the authority to approve or apply exemptions and exceptions in emergency situations (natural disasters, epidemics, wars) or other objective situations to avoid disrupting operations while ensuring aviation safety principles.
Notably, the draft proposes to abolish 8 out of 24 groups of administrative procedures currently regulated in the current law, such as: procedures for registering transport regulations, granting licenses to establish representative offices/ticket sales of foreign airlines, registering airports under construction and some procedures related to aviation staff; at the same time, promoting decentralization and delegation of authority in state management of civil aviation, transferring some administrative procedures from the central level to specialized agencies and localities for implementation.
Regarding aviation safety, the draft has added specific regulations on system safety management, including 8 key elements of the safety monitoring system (SMS) and expanded the application of SMS to engine design and manufacturing organizations. Regulations on airspace organization and exploitation have also been adjusted in the direction of the State unifying management, protection and optimization of exploitation, ensuring harmony between socio -economic development and national defense and security; abolishing the content of "flight information region planning" to conform to international practice and practice.
According to the Ministry of Construction, to overcome the lack of synchronization between the provisions on labor contracts in the Law on Civil Aviation of Vietnam and the Labor Code, the draft allows businesses to be more proactive and flexible in recruitment (including the form of labor leasing). The state management agency specializing in aviation will issue licenses, while training facilities will issue professional certificates for human resources in this industry. Another notable content is to clarify health requirements as mandatory conditions for flight crew members, flight attendants, and air traffic controllers according to the International Civil Aviation Organization.
