The Ministry of Home Affairs has issued Official Dispatch No. 4753/BNV-CQDP on resolving difficulties and problems in the process of implementing the 2-level local government model.
The dispatch clearly stated that, implementing Document No. 15826-CV/VPTW dated July 2, 2025 and Document No. 15843-CV/VPTW dated July 3, 2025 of the Central Party Office on the implementation of the 2-level local government model in localities, the Ministry of Home Affairs requested the Standing Committees of Provincial Party Committees, City Party Committees and People's Committees of provinces and cities to pay attention to and direct the implementation of the following contents:
Firstly, direct relevant agencies to review, support and thoroughly resolve difficulties and problems at the local level, especially those related to the arrangement, assignment and resolution of regimes and policies for cadres, civil servants, public employees and workers; arrangement of working offices; public disclosure and implementation of administrative procedures to serve people and businesses; archiving and digitizing documents... to ensure timeliness and efficiency, to avoid prolongation, delay and lateness, and to avoid hot spots and disunity.
Second, regarding the content of archiving and digitizing documents when implementing the 2-level local government model:
Continue to strictly implement urgent solutions on documents and archives in Official Dispatch No. 414/BNV-VTLTNN dated March 19, 2025 of the Ministry of Home Affairs on strengthening the management of documents and archives in the process of reorganizing the apparatus of the political system according to Conclusion No. 127-KL/TW of the Politburo.
Proactively develop and approve projects and plans for managing and processing business operations for documents and document databases that have been compiled compiled before arranging the organizational structure.
Continue to implement Official Dispatch No. 851/BNV-CVT
Urgently select archival document digitization software with functions that meet the business processes and data standards of digitized archival documents prescribed in Circular No. 05/2025/TT-BNV dated May 14, 2025 of the Minister of Home Affairs regulating the business of storing digital archival documents.
The Ministry of Home Affairs has been collecting the needs for technology transfer to build digital archive management software, use the Digital Archives of localities and has a plan to work directly with localities on this content in the coming time. structured, it is recommended that localities synthesize the needs and send them to the Ministry of Home Affairs (Department of State Records and Archives) before July 10, 2025.
Third, regarding the content of resolving regimes and policies for cadres, civil servants, public employees and workers when implementing the arrangement:
Pursuant to the provisions of Decree No. 178/2024/ND-CP (amended and supplemented by Decree No. 67/2025/ND-CP), Circular No. 01/2025/TT-BNV dated January 17, 2025 (amended and supplemented by Circular No. 002/2025/TT-BNV dated April 4, 2025) and guiding documents of the Ministry of Home Affairs; In the process of arranging administrative units and organizing a 2-level local government model, if cadres, civil servants and public employees wish to immediately quit their jobs, the local Party Committee and government shall base on the Resolution of the National Assembly and the Standing Committee of the National Assembly on arranging provincial and commune-level administrative units and the Master Plan on arranging specialized agencies, administrative agencies and public service units when implementing the 2-level local government model of the locality to consider and decide to let cadres, civil servants, public employees and employees quit their jobs and immediately enjoy policies and regimes according to Decree No. 178/2024/ND-CP (amended and supplemented in Decree No. 67/2025/ND-CP).
If cadres, civil servants, and public employees wish to immediately resign, local Party committees and authorities shall base on the Resolution of the National Assembly and the Standing Committee of the National Assembly on the arrangement of provincial and communal administrative units and the Master Plan on the arrangement of specialized agencies, administrative agencies, and public service units when implementing the local 2-level local government model to consider and decide to allow cadres, civil servants, public employees, and employees to resign and immediately enjoy policies and regimes according to Decree No. 178/2024/ND-CP. |
Fourthly, regarding the arrangement and assignment of non-professional staff at the communal level when implementing the two-level local government model, the Government Steering Committee issued Document No. 12/CV-BCĐ dated June 20, 2025, guiding a number of contents on the arrangement and assignment of non-professional staff at the commune level when implementing the two-level local government model; at the same time, the Government issued Decree No. 170/2025/ND-CP dated June 30, 2025, regulating the recruitment, use and management of civil servants, effective from July 1, 2025, which stipulates that non-professional staff at the commune level are one of the subjects accepted to work as civil servants when meeting the standards and conditions for acceptance according to regulations.
Fifth, regarding the procedure for converting villages and residential groups and renaming villages and residential groups at newly formed commune-level administrative units after the arrangement according to the new provisions of the Law on Organization of Local Government (Law No. 72/2025/QH15), the Ministry of Home Affairs issued Document No. 4168/BNV-CQDP dated June 23, 2025 guiding a number of contents on the arrangement of the apparatus and administrative units, including guiding the contents related to the above-mentioned villages and residential groups (attached).
During the implementation process, if difficulties and problems continue to arise, the Provincial Party Committee, City Party Committee and People's Committees of provinces and centrally-run cities are requested to promptly report to the Ministry of Home Affairs and relevant ministries and agencies for guidance according to their authority.
