This Circular details Clause 9, Article 12 of Decree No. 163/2024/ND-CP dated December 24, 2024 of the Government detailing a number of articles and measures to implement the Law on Telecommunications on conditions for network switching; network switching procedures; responsibilities of parties participating in network switching; technical process for network switching.
The subjects of application are enterprises licensed to provide terrestrial mobile telecommunications services and agencies, organizations, enterprises and individuals related to network switching.
According to the Circular, the condition for the status of a mobile subscriber at the time of registering for network switching service is that the subscriber is active in both directions on the network of the transferring enterprise.
Regarding subscriber information, the subscriber information registered for network switching service at the incoming business matches the subscriber's information at the outgoing business, including the following basic information:
For personal subscriber information, the number and type of documents used to register the H2H mobile subscriber number (uniformly planned terrestrial mobile telecommunications network used for person-to-person communication) as prescribed in Points a and b, Clause 1, Article 17 of Decree 163/2024/ND-CP.
For information of organizational subscribers: the number and type of legal entity identification documents as prescribed by civil law or organization registration establishment documents as prescribed by law used to register H2H mobile subscriber information. In case an organization assigns an individual to use the SIM, the individual's information must match as prescribed.
Regarding the service usage time, for the number of subscribers who won the auction to register for the first network switching service, the service usage time at the original enterprise is implemented according to the provisions of Clause 3, Article 45 of Decree 115/2025/ND-CP dated June 3, 2025 detailing a number of articles of the Telecommunications Law on the management of telecommunications number warehouses and Internet resources; compensation when the State revokes codes, telecommunications numbers, Internet resources; auction of the right to use codes, telecommunications numbers, and Vietnamese national domain names ".vn"
For directly allocated subscribers registering for the first network switching service, the time to activate the terrestrial mobile telecommunications service at the original enterprise is at least 90 days before the time of registering for the network switching service.
For subscribers registering for network switching service from the second time (including subscribers winning the auction and subscribers directly allocated), the time to activate the terrestrial mobile telecommunications service at the transferring enterprise is at least 60 days before the time of registering for network switching service.
Regarding terrestrial mobile information service fees, postpaid subscribers must simultaneously meet the following conditions: Having completed payment obligations for payment periods prior to the time of registering for network switching services; Fees incurred during the period at the time of registration for network switching services must not exceed VND 500,000.
Conditions for using international roaming services: Postpaid subscribers must not use international roaming services within 60 days prior to registering for network switching services.
In addition, the Circular also stipulates other conditions related to network switching. That is, the subscriber does not violate the acts specified in Article 9 of the Telecommunications Law or at the request of authorized state agencies; has no complaints or disputes regarding the right to use the subscriber number at the transferring enterprise; and is not in the process of performing another network switching transaction.
The subscriber does not violate the contract for provision and use of telecommunications services or general terms of transaction with the transferring enterprise. In case of refusal to allow the subscriber to transfer network according to this regulation, the transferring enterprise must notify the subscriber to register for network transfer service according to the regulations and the transferring enterprise, the authorized state agency according to the regulations.
The forms of registration for mobile subscribers' network switching services are stipulated in the Circular as follows: Online through the use of applications provided by the transferring enterprise; directly at points directly owned and established by the transferring enterprise (with a fixed address or mobile); directly at points with a fixed address established by other enterprises, authorized by the transferring enterprise to sign a contract to perform network switching service registration.
