Pursuant to Decision No. 1244 dated July 3, 2025 of the President, special amnesty is granted to those sentenced to fixed-term imprisonment or life imprisonment on the occasion of the 80th National Day of the Socialist Republic of Vietnam. The time served in prison for consideration of special amnesty is calculated up to August 31, 2025.
Subjects eligible for amnesty include those serving a fixed-term prison sentence, those sentenced to life imprisonment that has been suspended to a fixed-term prison sentence, and those whose prison sentence is temporarily.
Speaking at the press conference, Deputy Head of the Office of the President Pham Thanh Ha said that in recent years, the Vietnamese State has carried out many amnesties for hundreds of thousands of prisoners who have successfully reformed, worked and studied and returned to the community and society. This affirms the consistent policy of the Party and State of Vietnam in promoting and protecting human rights in a fair and equal manner for all citizens, including those serving prison sentences.

2025 is a year of many important events and major holidays of the country. Recently, on the occasion of the 50th anniversary of the Liberation of the South and National Reunification Day, April 30, 2025, the President decided to grant amnesty and early release to more than 8,000 prisoners. "Although the number of people granted amnesty is large, the political security situation and social order and safety are still guaranteed. There are no complications caused by the amnestied people. Most of the amnestied people have returned to their places of residence, lives and worked honestly. The amnesty work has secured political, legal, professional and foreign affairs requirements, and has been approved by the people in the country and highly appreciated by international public opinion," said Deputy Head of the Office of the President Pham Thanh Ha.
Based on the humane tradition of the nation and the lenient policy of the Party and State of Vietnam towards criminals, as well as the results of the implementation of the amnesty work on April 30, 2025 and the actual situation of the execution of prison sentences in the past time, at the request of the Government, on July 3, 2025, President of the Socialist Republic of Vietnam Luong Cuong signed Decision No. 1244 on the second amnesty in 2025, on the occasion of the 80th anniversary of the National Day of the Socialist Republic of Vietnam, September 2, 2025.

Answering a reporter's question, Senior Lieutenant General Le Van Tuyen, Deputy Minister of Public Security, said: This is not the first time there has been two amnesty periods in one year. Previously, in 2009 and 2011, there were also two amnesty periods on April 30 and September 2.

The second new point is related to the classification of emulation consideration. Print Instruction No. 94 dated July 4 of the Amnesty Advisory Council, the regulation clearly stated that the emulation consideration period for each type of crime is more extended than the regulation applied to subjects granted amnesty under Decision 266.
The third new point in the Guidance of the Advisory Council for Special Amnesty this time is related to the criterion of "not affecting security and order" when considering special amnesty. In this special amnesty, the guidance has specified this criterion very specifically, as a basis for detention facilities under the People's Public Security and People's Army to implement uniformly nationally. The assessment of the criteria is based on comments from local police, to ensure publicity and transparency in the special amnesty consideration process.
