The Minister ofEducation and Training said he will continue to propose to the Government to include tutoring and extra-curricular services in the list of conditional business lines.

A report on some contents related to the group of questions at the 9th Session of the 15th National Assembly has just been sent by Minister of Education and Training Nguyen Kim Son to National Assembly delegates.

Implementing legal regulations on extra teaching and learning is one of the issues that the National Assembly decided to question the Minister of Education and Training at the 9th Session.

According to the Minister's assessment, nearly 3 decades have passed, with legal regulations on extra teaching and learning, the warning about rampant extra teaching and learning still remains relevant.


Instead of being reduced, extra teaching and learning are increasingly occurring on a larger scale in many forms. This not only puts great pressure on students and their parents, but also goes against the spirit of innovation in Resolution No. 29-NQ/TW in 2013 on fundamental and comprehensive innovation in education and training, which aims to shift from “knowledge transfer” to “developing learners’ qualities and capacities”, contrary to the goal of the 2018 General Education Program which emphasizes building people who are autonomous, creative and capable of lifelong learning, while rampant extra teaching and learning are undermining the true value of learning.

The Ministry of Education and Training has issued Circular 29 regulating extra teaching and learning. Initial results, according to Minister Nguyen Kim Son, are that the Circular's regulations limit the widespread and illegal situation of extra teaching and learning. Schools focus on improving the quality of teaching and learning of the main curriculum, ending paid extra teaching in schools, creating conditions for students to access knowledge without pressure on studying and finances.

The regulation that teachers are not allowed to teach students assigned by the school will avoid discrediting teachers who give legitimate tutoring, and strengthen the prestige and honor of teachers. Teachers' awareness of income tax obligations and the value of professional self-improvement will change, the report stated.

Regarding limitations, the Minister assessed that since 2020, when tutoring and tutoring are no longer conditional business lines, management has become more difficult, and localities do not know the sanctions to handle violations. The list of acts requiring administrative sanctions in the education sector currently lacks some violations of regulations on tutoring and tutoring that need to be supplemented (currently, localities have proactively based on the sanctions regulations under the Law on Civil Servants and Public Employees and other relevant laws to handle violations).


Since the implementation of Circular 29, some localities have not issued regulations on extra teaching and learning according to their authority, leading to confusion in implementation. The coordination between departments and branches in implementing regulations on extra teaching and learning outside of school has not been timely and drastic in some places, so there are still cases of intentional violations of the Circular's regulations on extra teaching and learning outside of school.

Part of the reason, according to the report, is that when tutoring and extra-curricular services were removed from the list of conditional business lines, it led to a situation in some localities where tutoring and extra-curricular activities inside and outside schools were uncontrolled and spontaneous due to the inability to manage the licensing of tutoring and extra-curricular activities.

The Minister also said that in order to help manage tutoring and learning activities in localities and educational institutions more closely, the Ministry of Education and Training has repeatedly proposed to the Government and the National Assembly to include tutoring and learning services in the list of conditional business lines of the Investment Law at the 9th Session of the 14th National Assembly, however, to date, this proposal has not been approved.

Therefore, the provisions of Circular 29 aim to not stipulate conditions (to manage conditional business lines), but emphasize the most basic management solutions to ensure the quality of education, especially for extracurricular teaching facilities such as working hours, moral qualities, professional capacity of teachers, information disclosure to enhance post-inspection, increase publicity, transparency and rely on the supervision mechanism of the whole society to improve management efficiency.

Regarding solutions, Minister Nguyen Kim Son stated that extra teaching and learning is a complex issue with great social impact, therefore, a Circular regulating the management of extra teaching and learning cannot solve all the problems. It is necessary to have systematic, synchronous, and drastic solutions. Implementation needs a roadmap, and at the same time, there needs to be modern solutions, updated with advances in science and technology.
