Cosmetic products are completely manufactured at each different manufacturing company, so each company has its own separate declaration.
Circular 34/2025/TT-BYT amends and supplements Article 5 of Circular No. 06/2011/TT-BYT on how to prepare a Cosmetic Product Declaration Form.
Accordingly, the Cosmetic Product Declaration Form shall be implemented according to the provisions in Appendix No. 01-MP issued with this Circular. The way to write the contents in the Cosmetic Product Declaration Form shall be implemented according to the provisions in Appendix No. 02-MP issued with this Circular.
In case of submitting cosmetic product declaration dossier online : The declaration form must be signed by the legal representative or the person authorized by the legal representative, clearly stating the full name and stamped (accepting electronic signature or digital signature). In case the organization or individual responsible for bringing the product to the market is a business household, it is not required to stamp the business household's stamp on the Declaration form.
In case of submitting cosmetic product declaration dossier directly or via postal service: The declaration form must be signed by the legal representative or the person authorized by the legal representative, clearly stating the full name and stamping (no signature and seal are allowed), with the seal on the edges (in case the declaration form consists of 02 or more pages). In case the organization or individual responsible for bringing the product to the market is a business household, it is not required to stamp the business household's seal on the Declaration form, the business household owner must sign on all pages containing information of the Declaration form.
Each cosmetic product is declared in a Declaration Form.
Cosmetic products are completely manufactured at different manufacturing companies, each must be declared separately. In case there are two or more companies participating in the production stages to produce a complete product, they must be jointly established in one Declaration Form and must clearly state the name, full address, and production stages of each company.
Products with the same product owner falling into one of the following cases are allowed to be declared in one Declaration Form:
The products are packaged under a generic name and sold as a set of products.
Products with the same name and product line have similar formulas but different colors or scents, except for hair dyes and perfumes, which must be declared separately for each color and scent.
Other forms will be decided by the Drug Administration of Vietnam - Ministry of Health based on the decision of the ASEAN Cosmetic Council.
How to write the ingredients in cosmetic products
a- Ingredients in the product formula must be listed in full in order of decreasing content. Perfume ingredients, fragrances and their ingredients may be listed as “perfume, fragrance, flavour, aroma”. Ingredients with a content of less than 1% may be listed in any order after ingredients with a content of more than 1%. Colorants may be listed in any order after other ingredients according to the color index (CI) or by name as in Annex IV of the ASEAN Cosmetics Directive. Cosmetic products intended for make-up, in different colors, may list all colorants under the “may contain” or “+/-” section.
b- State the full percentage of ingredients with concentration and content limits specified in the Annexes of the ASEAN Cosmetic Agreement. The unit and decimal places are marked with a comma (“,”).
c- The names of ingredients must be written in the International Nomenclature of Cosmetic Ingredients (INCI) as prescribed in the latest publications: International Cosmetic Ingredient Dictionary, British Pharmacopoeia, United States Pharmacopoeia, Chemical Abstract Services, Japanese Standard Cosmetic Ingredient, Japanese Cosmetic Ingredients Codex. The names of plants and plant extracts must be written in scientific names including the genus and species of the plant (the genus name may be shortened). Ingredients of animal origin must state the exact scientific name of the animal species.
d- The following substances are not considered ingredients of cosmetics: Impurities in the raw materials used; auxiliary materials used for technical purposes but not present in the finished product; materials used in necessary quantities as solvents or carriers of fragrance ingredients.
The language used in the Declaration Form is Vietnamese or English. The contents stated in Section 3 (Purpose of use), Section 8 (Information about the organization or individual responsible for bringing the product to the market), Section 9 (Information about the legal representative of the Company), Section 10 (Information about the importing Company) in the Declaration Form must be written in Vietnamese or Vietnamese and English.
The Circular takes effect from August 18, 2025.
