Pursuant to the provisions of Decree No. 178/2024/ND-CP (amended and supplemented by Decree No. 67/2025/ND-CP), Circular No. 01/2025/TT-BNV dated January 17, 2025 (amended and supplemented by Circular No. 002/2025/TT-BNV dated April 4, 2025) and guiding documents of the Ministry of Home Affairs; In the process of arranging administrative units and organizing a 2-level local government model, if cadres, civil servants and public employees wish to immediately quit their jobs, the local Party Committee and government shall base on the Resolution of the National Assembly and the Standing Committee of the National Assembly on arranging provincial and commune-level administrative units and the Master Plan on arranging specialized agencies, administrative agencies and public service units when implementing the 2-level local government model of the locality to consider and decide to let cadres, civil servants, public employees and employees quit their jobs and immediately enjoy policies and regimes according to Decree No. 178/2024/ND-CP (amended and supplemented in Decree No. 67/2025/ND-CP).
Regarding the procedure for converting villages and residential groups and renaming villages and residential groups according to newly formed commune-level administrative units after the arrangement to the new provisions of the Law on Organization of Local Government, the Ministry of Home Affairs issued Document No. 4168/BNV-CQDP dated June 23, 2025 guiding a number of contents on the arrangement of the apparatus and administrative units, including guiding the contents related to villages and residential groups.

Standards and conditions for acceptance:
Based on the proportion of civil servants to be arranged for each job position in the agency using civil servants, the assigned payroll quota and the requirements of the job position to be recruited, the head of the competent recruiting agency or the head of the management agency shall consider and accept as civil servants the cases that meet the conditions for registering for civil servant recruitment as prescribed in Clause 1, Article 19 of the Law on Cadres and Civil Servants, except for the cases prescribed in Clause 3, Article 19 of the Law on Cadres and Civil Servants or are in the period of disciplinary action, are in the period of implementing disciplinary decisions, are in the period of implementing regulations related to discipline according to the provisions of the Party and the law.
For non-professional workers at the commune level, they must have at least 5 years of work experience in accordance with the provisions of law, have paid compulsory social insurance (if not continuous and have not received social insurance benefits at one time, it can be accumulated, including previous working time if any in the job position), do work with professional and technical requirements suitable for the job in the expected job position).
