The case of Miss Phuong Le's lyrics National Anthem on livestream is being criticized across social networking forums. In the face of outrage from the community and public opinion, Phuong Le had to speak up to explain and apologize.

The Inspectorate of the Department of Information and Communications of Ho Chi Minh City said it will investigate the incident and coordinate with relevant agencies to handle it according to regulations.

Miss Phuong Le was born in 1979 (from Tra Vinh). She became famous after winning the 2016 Miss Vietnamese Businesswoman of the World. In 2017, Phuong Le won the Mrs. World Peace pageant.

Phuong Le's act of parodying the National Anthem was criticized by the audience as being too "innocent", and more than that, showing a lack of understanding and respect for national symbols like the National Anthem.

The song “Tien Quan Ca” was composed by musician Van Cao in 1944. The song was chosen as the National Anthem of the Democratic Republic of Vietnam from August 13, 1945 to July 1, 1976, and continued to be chosen as the National Anthem of the Socialist Republic of Vietnam from July 2, 1976.

According to the Penal Code No. 100/2015/QH13 dated November 27, 2015 of the National Assembly , effective from January 1, 2018, Article 351 clearly states:

“Article 351. Crime of insulting the National Flag, National Emblem, and National Anthem

Anyone who intentionally insults the National Flag, National Emblem, or National Anthem shall be subject to a warning, non-custodial reform for up to 3 years, or imprisonment from 6 months to 3 years.

Thus, for the crime of insulting the National Flag and National Anthem - the highest prison sentence is up to 3 years.

The national anthem (along with the national flag and national emblem) are sacred symbols of the Fatherland and the pride of the nation and people.

Acts of insulting the national flag, national emblem or altering the lyrics or distorting the national anthem are dangerous acts that violate the dignity and sacredness of the nation and people.

Currently, there are no specific regulations on administrative penalties for insulting or modifying the National Anthem. Reporters continue to update the opinions of the authorities on the level of violation committed by Miss Phuong Le when modifying the National Anthem on Livestream. This behavior is dangerous because it can create a negative impact on cyberspace about the National Anthem.
