Studying abroad with state budget can stay abroad to continue studying

The Ministry of Education and Training proposed that the Government allow international students studying abroad with state funding to stay after completing their course to continue their studies or do internships after graduation.

The Ministry of Education and Training has just announced a draft decree amending and supplementing a number of articles of Decree No. 86/2021/ND-CP dated September 25, 2021 regulating Vietnamese citizens going abroad to study, teach, conduct scientific research and conduct academic exchanges. In this draft, the Ministry of Education and Training has proposed allowing international students studying abroad with state funding to continue their studies abroad.

Specifically, the Ministry of Education and Training has added a clause to Article 10 (Article on Receiving State Budget Scholarship Students Returning Home) allowing students who would otherwise have returned home to stay abroad to continue studying at a higher level or to do internships after graduation.

The condition attached to the above regulation is that the student's stay abroad must be approved by the sending agency or the direct management agency (in case of having a work agency). At the same time, the student will not be given a plane ticket back home.

According to the Ministry of Education and Training, the implementation of Decree 86 in recent times has shown that there are international students studying abroad with state budget after graduating from the course, staying abroad to study at a higher level or do internships after graduation. However, Decree 86/2021/ND-CP does not yet regulate this case, so relevant agencies have encountered difficulties in handling it.

In addition to the above content, the draft decree amending and supplementing a number of articles of Decree 86 has added regulations on exemption from training cost reimbursement for cases where international students do not complete the course due to force majeure (health, war, natural disasters, epidemics); amending regulations on the time for refunding compensation costs; methods of paying compensation costs; adding responsibilities of international students' families in refunding compensation costs to the State.

The Ministry of Education and Training explained: "This regulation aims to improve the effectiveness of the management of international students receiving state budget scholarships; provide additional grounds for sending agencies and agencies directly managing international students to consider exempting refunds for international students who do not complete the course due to force majeure; and increase the feasibility of recovering refund costs."
