According to DSEZA, in recent times, many investors, after being allocated land, have not implemented projects on schedule, or have used land for the wrong purpose, and have arbitrarily divided and sub-leased the premises to secondary businesses without permission from the authorities. This situation has been happening quietly, without ensuring conditions for fire prevention and fighting, labor safety, environment and construction planning.
Illegal leasing activities not only distort the investment environment and create unhealthy competition, but also lead to the risk of losing state budget revenue due to the failure to collect land rent, infrastructure fees and technical services. Many sub-leasing facilities operate in substandard factories, do not register for appropriate business lines, and seriously violate fire prevention and fighting regulations. In fact, tragic accidents have occurred in some localities, showing the consequences of lax supervision of production activities in illegally sub-leasing factories.
DSEZA said that legally, the Investment Law, Land Law and related documents do not allow infrastructure investors or land-using enterprises to arbitrarily sublease without approval. This behavior not only violates the law but also directly affects the effort to attract projects with financial and technological capacity that Da Nang City is prioritizing.
Faced with this situation, DSEZA is conducting a comprehensive review of projects in industrial parks, especially those that are slow to implement, used for the wrong purpose or have signs of illegal leasing. The authorities will strengthen inspections and strictly handle violations, including land reclamation and project termination if necessary.
In addition, DSEZA will coordinate with relevant departments and branches to guide enterprises in adjusting their investment goals in accordance with legal regulations. Legal information related to land and factories in industrial parks will also be made transparent to help secondary enterprises be proactive and avoid renting premises that do not meet legal requirements.
