252 diseases and groups of diseases are applied for outpatient prescriptions for more than 30 days

The Ministry of Health has just issued Circular No. 26/2025/TT-BYT dated June 30, 2025, effective from July 1, 2025, regulating prescriptions and prescriptions of pharmaceutical and biological drugs in outpatient treatment at medical examination and treatment facilities.

The Ministry of Health has just issued Circular No. 26/2025/TT-BYT dated June 30, 2025, effective from July 1, 2025, regulating prescriptions and prescriptions of pharmaceutical and biological drugs in outpatient treatment at medical examination and treatment facilities.

Notably, the Circular has issued a List of diseases and groups of diseases that are eligible for outpatient prescriptions for more than 30 days, including 252 diseases and groups of diseases. For diseases in this List, the prescriber decides the number of days of use of each drug in the prescription based on the clinical condition and stability of the patient to prescribe the drug with the maximum number of days of use of each drug not exceeding 90 days.

Thus, in cases where documents used as a basis for prescribing drugs such as drug instructions, diagnosis and treatment instructions, and the Vietnamese national pharmacopoeia do not provide instructions on the number of days of drug use, prescribers have a basis to decide to prescribe up to 90 days for appropriate patients.

Along with that, the Circular adds a number of mandatory information fields in the prescription, including information about the patient's personal identification number or citizen identification number or identity number or passport number. Timely updates in the spirit of connecting citizens' electronic data: Vietnamese citizens providing personal identification numbers do not need to declare information about gender, date of birth, and permanent address.

However, the prescriber must clearly state the amount to be used each time, the number of times to be used per day, and the number of days to use the medicine in the prescription for the patient.

In particular, this Circular updates new regulations under the 2023 Law on Medical Examination and Treatment, such as: Prescription of drugs must comply with technical regulations issued or recognized by the Minister of Health ; The use of drugs in medical examination and treatment must ensure the following principles: (1) Prescribing drugs when absolutely necessary, for the right purpose, safely, reasonably and effectively; (2) Prescription of drugs must be consistent with the diagnosis, medical condition of the patient and the Law on Pharmacy amended and supplemented in 2024, such as: Regulations on handling addictive drugs, psychotropic drugs, precursor drugs that have been sold/given to patients but not fully used or have resulted in death.

Specifically, when prescribing addictive drugs for acute treatment, the quantity of drugs used must not exceed 7 days. The prescriber shall instruct the patient or the patient's representative (in case the patient cannot go to the medical examination and treatment facility or the patient does not have full civil capacity) to write a commitment on the use of addictive drugs. The commitment is written according to the form specified in Appendix IV issued with this Circular, made in 02 identical copies, of which: 01 copy is kept at the medical examination and treatment facility, 01 copy is given to the patient or the patient's representative. The medical examination and treatment facility must make a list of sample signatures of the person prescribing addictive drugs of the facility and send it to relevant facility departments of the medical examination and treatment for information.

When prescribing narcotic drugs to relieve pain for cancer patients, medical examination and treatment facilities, when diagnosing and confirming that the patient has cancer, will prepare an outpatient medical record for the patient. The prescriber will instruct the patient or the patient's representative to write a commitment to use narcotic drugs according to the provisions of Clause 3, Article 7 of this Circular. Each prescription is for a maximum of 30 days, and must specifically state 3 consecutive treatment periods on 1 prescription, each period not exceeding 10 days (clearly stating the start and end dates of the treatment period).

In the case of prescribing narcotic drugs to relieve pain for cancer patients who are at home and cannot go to a medical examination and treatment facility, the prescription of narcotic drugs must be made by a doctor at a medical examination and treatment facility with inpatient beds. The patient must have confirmation that he/she needs to continue pain treatment with narcotic drugs from the head of the health station of the commune, ward, or special zone where the patient resides, according to the prescribed form, along with a summary of the medical record according to the form. In the case where the last medical examination and treatment facility prescribes the drug for the patient, there is no need for a summary of the medical record...
