Removing difficulties in implementing the Law on Geology and Minerals

(Baothanhhoa.vn) - On the afternoon of September 3, Deputy Prime Minister Tran Hong Ha chaired a conference to listen to and give opinions on the Draft Resolution of the Government on promulgating specific mechanisms and policies to remove difficulties in implementing the Law on Geology and Minerals 2024 and the Draft Law amending and supplementing a number of articles of the Law on Geology and Minerals 2024. The conference was connected online to 13 provinces and cities.

The Draft Resolution provides specific mechanisms and policies to remove difficulties in implementing the Law on Geology and Minerals in 2024. Typically, allowing the exploitation of Group IV minerals to provide materials for works, projects, and tasks to be applied as prescribed in Clause 2, Article 72 and Point d, Clause 2, Article 73 of the Law on Geology and Minerals, including: Public investment projects according to the provisions of the law on public investment; Investment projects implemented under the public-private partnership (PPP) method according to the provisions of the law on investment under the public-private partnership method; key and important national works and projects; socio -economic development works and projects under the authority of approval and investment policy decisions of local authorities according to the provisions of the law on investment and public investment, which are considered and decided by the Chairman of the Provincial People's Committee to apply according to the specific mechanisms and policies of this Resolution; urgent construction works, urgent tasks as prescribed by law on construction; projects, works for natural disaster prevention as prescribed by law on natural disaster prevention.

Allows exemption from procedures for mineral exploration licenses, recognition of mineral exploration results, mineral exploitation licenses, and mineral recovery registration certificates when exploiting and recovering group III minerals and group IV minerals to respond to emergencies related to natural disasters, epidemics, security, and national defense.

In particular, the Draft Resolution adds Clauses 10 and 11 after Clause 9, Article 153 of Decree No. 193/2025/ND-CP dated July 2, 2025 of the Government detailing a number of articles and measures to implement the Law on Geology and Minerals as follows:

For organizations and individuals who were granted mineral exploration licenses before the mineral planning was approved by the Prime Minister in Decision No. 866/QD-TTg, dated July 18, 2023 and Decision No. 1626/QD-TTg, dated December 15, 2023 and have submitted applications for mineral exploitation licenses but the content of mineral processing, purpose of use, mineral consumption, and exploitation capacity is not suitable, mineral exploitation licenses will be granted according to the submitted documents...

Discussing at the conference, delegates basically agreed with the content of the Draft Resolution; Draft Law amending and supplementing a number of articles of the Law on Geology and Minerals 2024 and believed that the issuance of the Resolution on specific mechanisms and policies to remove difficulties in implementing the Law on Geology and Minerals 2024 is consistent with the spirit of Resolution No. 206/2025/QH15 of the 15th National Assembly on special mechanisms to handle difficulties and obstacles due to legal provisions.

According to delegates, this is an urgent and important issue in the locality, which needs to be resolved soon to speed up procedures for implementing construction investment projects, and key projects that need to start construction to contribute to promoting socio-economic development.

Concluding the conference, Deputy Prime Minister Tran Hong Ha stated: The issuance of the Government's Resolution on promulgating special mechanisms and policies to remove difficulties in implementing the Law on Geology and Minerals in 2024 is to solve urgent and immediate problems. Therefore, the content of the Resolution must be close to the requirements set forth in Resolution No. 206/2025/QH15 of the 15th National Assembly on special mechanisms to handle difficulties and problems caused by legal provisions.

The Deputy Prime Minister requested the drafting unit to absorb the comments of delegates at the conference, study and supplement the content of the Draft Resolution; Draft Law amending and supplementing a number of articles of the Law on Geology and Minerals in 2024 as required, ensuring high feasibility. When the Resolution and the amended Law are issued, approved and take effect, localities must proactively develop plans and implementation plans and take responsibility for performing assigned tasks, ensuring ecological environment safety, planning, and best serving the socio-economic development goals.
