Regulations on 5 prohibited acts in storing and using documents

The Law on Archives (amended) consists of 8 chapters and 65 articles, adding 11 articles, removing 12 articles; separating and merging 9 articles into 7 new articles compared to the draft Law submitted by the Government to the National Assembly .

The promulgation of the Law on Archives (amended) aims to institutionalize the Party and State's guidelines and policies on promoting the application and development of information technology to meet the requirements of sustainable development and international integration; innovate management activities and perform archival operations, and overcome shortcomings and limitations in current archival practices.

The Law on Archives (amended) stipulates the management of archival documents and archival document databases; archival operations; archival documents of special value and promoting the value of archival documents; private archives; archival service activities and state management of archives.

The storage of documents belonging to the State Archives of Vietnam and private archives of special value must comply with the provisions of this Law, except in cases where the archives are recognized as national treasures or recognized or registered in other forms according to the provisions of the Law on Cultural Heritage and other relevant laws. In addition to complying with the provisions of this Law, the provisions of the Law on Cultural Heritage and other relevant laws must also be complied with.

The Prime Minister shall decide on the transfer of archival documents recognized as national treasures abroad. In case another law has different provisions on the storage period and responsibility for managing archival documents at the current archives, the provisions of that law shall apply....

Regarding the State's policy on archives, the Law on Archives (amended) stipulates: Building a modern Vietnamese archives system, meeting the requirements of state management, modernizing the administrative system, serving the people. Ensuring the necessary conditions for archives.

Prioritize public investment capital and other resources to modernize archives, ensure safety, integrity and promote the value of archival documents. Build and develop professional archival human resources to serve; train and build a team of leading experts in the field of archival; attract high-quality human resources to carry out archival activities.

In addition, build an archival society, encourage organizations, individuals, families, clans, and communities to protect, preserve, and promote the value of private archival documents. Socialize archives; create favorable conditions for domestic organizations and individuals to invest in and do business in archival services...

The Law on Archives (amended) clearly stipulates five prohibited acts, including: Illegally transferring, providing, destroying or intentionally damaging, buying, selling, appropriating, or losing archival documents managed by competent agencies of the Party and State;

Falsifying, distorting the content, destroying the integrity of archival documents and master data of archival documents; illegally accessing, copying, sharing archival documents and archival document databases;

Unauthorized destruction of private archives of special value;

Using archives or taking advantage of archival services to infringe upon national and ethnic interests, public interests, and the legitimate rights and interests of agencies, organizations, individuals, families, clans, and communities. Obstructing the right to access and legally use archival documents of agencies, organizations, and individuals;

Bringing archival documents abroad, out of current archives, historical archives contrary to the provisions of law.

The Law on Archives (amended) also specifically stipulates: Management of archival documents and archival document databases; Archival operations; archival documents of special value and promoting the value of archival documents; private archives... In particular, the Law on Archives (amended) this time has stipulated that January 3 of each year is Vietnam Archives Day.
