Proposal to apply specific mechanisms and policies for Tan Phu - Bao Loc expressway
Lam Dong Provincial People's Committee has just proposed applying special mechanisms and policies for the Tan Phu ( Dong Nai ) - Bao Loc (Lam Dong) Expressway Project.
Lam Dong Provincial People's Committee has just issued a report to summarize Resolution No. 106/2023/QH15 of the National Assembly on piloting a number of specific policies on investment in road construction.
It is noteworthy that Lam Dong Provincial People's Committee proposed to apply special mechanisms and policies for the Tan Phu (Dong Nai) - Bao Loc (Lam Dong) Expressway Project.
Specifically, the Tan Phu (Dong Nai province) - Bao Loc (Lam Dong province) expressway project under the public-private partnership method was assigned by the Prime Minister to supplement the medium-term public investment plan with central budget capital (domestic capital) for the period 2021 - 2025 in Decision No. 888/QD-TTg dated July 24, 2023 with a capital of VND 2,000 billion.
Pursuant to Notice No. 144/TB-VPCP dated April 20, 2023 of the Government Office, Lam Dong Provincial People's Committee is currently coordinating and reaching an agreement with Dong Nai Provincial People's Committee to report to the Prime Minister for approval of the adjustment of the allocation of the central budget capital allocated for the Tan Phu - Bao Loc Expressway Project in Decision No. 888/QD-TTg dated July 24, 2023 with a capital of VND 2,000 billion to allocate VND 420 billion to Dong Nai province and VND 1,580 billion to Lam Dong province to carry out compensation, support and resettlement work in Dong Nai province according to the value approved by the Prime Minister in the compensation, support and resettlement policy framework of the Tan Phu - Bao Loc Expressway Project.
However, Clause 9, Article 9 of the Budget Law stipulates that the budget of one locality cannot be used to pay for the tasks of another locality.
Therefore, Lam Dong Provincial People's Committee believes that in case the compensation, support and resettlement work in Dong Nai province exceeds the central budget allocated to Dong Nai province by 420 billion VND, Lam Dong will have to continue to balance and allocate local budget capital for Dong Nai province to complete the compensation, support and resettlement work, which will not be in accordance with the above regulations.
From there, Lam Dong Provincial People's Committee requested the Central Ministries and branches to study and propose additional special policy mechanisms to allow the Tan Phu - Bao Loc Expressway Project under the public-private partnership model to apply a special mechanism using local budgets to support other localities to carry out compensation, support and resettlement work.
