According to Circular No. 65/2020/TT-BCA dated June 19, 2020 of the Ministry of Public Security "Regulating the tasks, powers, forms, contents and procedures for patrolling, controlling and handling administrative violations of road traffic" of the traffic police (CSGT), there are regulations on the tasks of the CSGT in patrolling and controlling.

Specifically, the traffic police perform their duties and powers according to Article 7 of Circular No. 65/2020/TT-BCA. In particular, the task of the traffic police in patrolling and controlling is to ensure road traffic order and safety (TTATGT) on assigned routes and areas. The traffic police have the right to carry out patrol and control orders and plans approved by competent authorities.

The responsibility of the Traffic Police is to promptly detect, prevent and strictly handle violations related to traffic safety and other violations according to the provisions of the law. The Traffic Police also coordinates with road management agencies to protect road works and safety corridors. The Traffic Police is also responsible for investigating and resolving traffic accidents according to the provisions of the law and the Ministry of Public Security.

In addition to patrolling, controlling, and handling violations, traffic police also have the duty to detect shortcomings in security management and road traffic safety, then report and propose to competent authorities and make recommendations to functional agencies for timely remediation.

At the same time, traffic police guide, propagate and mobilize people to participate in ensuring road traffic safety and comply with road traffic laws.

Thus, the traffic police have an important responsibility in ensuring traffic safety and road order. Therefore, checking vehicles that are not in circulation is part of the work of preventing and handling administrative violations related to traffic and social safety, and ensuring that legal regulations are fully complied with.

In case the vehicle owner does not agree with the fact that his vehicle is not in circulation but is checked and detained by the traffic police, he can file a complaint against the record of the vehicle not in circulation being checked.

According to Clause 1, Article 15 of the Law on Handling of Administrative Violations 2012, individuals and organizations that are administratively sanctioned have the right to complain and file lawsuits against decisions on handling administrative violations according to the provisions of law.

Therefore, if the vehicle owner believes that the traffic violation report of the traffic police is illegal, he/she has the right to file a complaint about this issue.
