On the morning of June 14, continuing the program of the 9th Session, the National Assembly voted to pass the Law amending and supplementing a number of articles of the Law on Technical Standards and Regulations, with 432/448 total National Assembly deputies participating in the vote in favor.
According to the provisions of the law, individuals in production and business that are subject to technical regulations are responsible for declaring conformity for products, goods, services, processes, environments, and other subjects in socio-economic activities.
Regarding exemption from declaration of conformity, the law allows exemption from this for products and goods that fully meet the requirements on quality management as prescribed by other laws corresponding to the technical requirements in national technical regulations. Organizations and individuals register the declaration of conformity through the National Database on standards, measurement and quality.

Previously, in the report on receiving and explaining the draft law on the content of conformity declaration, Chairman of the National Assembly's Committee on Science, Technology and Environment Le Quang Huy stated the viewpoint of the National Assembly Standing Committee that conformity declaration includes two activities: Assessing the conformity of the subject of the conformity declaration with the corresponding technical regulations; Registering the conformity declaration at a specialized agency.
Accordingly, conformity assessment is the determination of whether products and goods are in accordance with the technical characteristics and management requirements specified in the applied technical regulations. This is the technical legal basis for state management agencies to conduct inspections, examinations, resolve disputes and handle violations of product and goods quality; create trust for consumers; and comply with the basic requirements of mutual recognition agreements and new generation trade agreements.
Therefore, Mr. Huy stated that the declaration of conformity is a necessary and important measure and tool to ensure effective state management, protect consumers, and enhance the brand of enterprises. Registering the declaration of conformity is an administrative procedure to notify the management agency.
To minimize administrative procedures and overcome duplication in conformity assessment activities, causing costly expenses for businesses, the law has stipulated the expansion of the use of conformity assessment results as a basis for conformity declaration activities.

In addition, the law also stipulates exemption from conformity declaration for products and goods that fully meet quality management requirements as prescribed by specialized laws (Clause 1a, Article 48) so that enterprises only have to comply with one process, instead of having to comply with two processes as at present.
At the same time, to promote the application of digital technology in the implementation of procedures for registration of conformity declarations, the law has revised the regulations on conformity registration in a simplified manner. Accordingly, organizations and individuals only need to notify the conformity declaration on the national database on standards, measurements and quality (Clause 2, Article 45).
In response to the suggestion that the specialized management ministry should proactively organize the implementation throughout the process of developing, appraising, and promulgating standards, ensuring that only one agency is assigned to take the lead in implementing a task and take primary responsibility, Mr. Huy informed that the draft has stipulated that the ministry and ministerial-level agency should take the lead in implementing it consistently throughout the process of developing, appraising, and promulgating standards, as shown in Article 27 on the responsibility for appraising national technical regulations, Article 32 on the order and procedures for developing, appraising, and promulgating technical regulations, Article 33 on the dossier and content of appraisal of draft technical regulation dossiers, and Article 35 on reviewing, amending, supplementing, replacing, and abolishing technical regulations.
Also according to Mr. Huy, absorbing the opinions of National Assembly deputies, the draft law has revised the regulations on the authority to appraise technical regulations for agencies issuing Vietnamese standards according to the Government's proposal and expressed as in Article 27 on the responsibility for appraising national technical regulations, Article 32 on the order and procedures for developing, appraising and promulgating technical regulations, Article 33 on the content of appraisal of draft technical regulation dossiers, Article 35 on reviewing, amending, supplementing, replacing and abolishing technical regulations to promote decentralization and delegation of authority, ensuring that one task is assigned to only one agency to preside over implementation and take primary responsibility, increasing flexibility in state management, reducing the time for appraisal and promulgation of Vietnamese standards.
