Instructions for editing land records, land databases... in new administrative units

From July 1, the 2-level local apparatus of Khanh Hoa province officially operates with 65 commune-level administrative units including: 48 communes, 16 wards and 1 special zone. Khanh Hoa Newspaper reporter discussed with Mr. Nguyen Minh Thu - Deputy Director of the Department of Agriculture and Environment (DARD) about regulations related to the handover, correction of cadastral records, land database, correction of land use right certificates, ownership of assets attached to land (red book - hereafter abbreviated as certificate - GCN) after the merger.

Ensuring smooth handling of administrative procedures on land

- Sir, after arranging and operating the 2-level local apparatus from July 1, how will the Department of Agriculture and Environment deploy and implement the preservation, handover and adjustment of land records to ensure the smooth operation of the new administrative unit?

- Pursuant to the guidance of the Ministry of Agriculture and Environment in Official Dispatch No. 991, dated April 11, 2025 on Guidance on adjusting cadastral records, land databases and synthesizing natural area data when arranging administrative units at all levels and the direction of the Provincial People's Committee, the Department of Agriculture and Environment has directed the provincial land management agencies and local authorities to review and compile a list of cadastral records and types of books and paper documents formed during the process of land management and use through the stages that are being archived at local levels to prepare for handover to the new administrative unit, serving land management work, avoiding loss of documents, which poses potential risks to management work.

For the certificate issuance book established by the competent land management agency at the district level (before July 1) when issuing the certificate for the first time, immediately after the administrative unit is reorganized, the handover will be carried out to the Branch of the Land Registration Office for storage and information provision when necessary. For the electronic cadastral records that are being stored and operated in the land database, the agencies will be directed to continue to exploit, manage, and serve the provision of services to people and businesses according to current regulations.

Regarding the principle of adjusting land records and land databases: Adjusting land records including land maps, land registers, land books and land certificates must be done simultaneously with updating and adjusting the local land database. Land records and land databases that are being managed, stored and operated must continue to be exploited, managed and used to provide services to people and businesses. Adjusting land records and land databases due to the rearrangement of administrative units must be done simultaneously with the settlement of administrative procedures on land and assets attached to land, ensuring smoothness, without causing congestion or obstacles for people and businesses.

People are not required to edit certificates after merger

- After the merger, many communes and wards in the province have changed in area and new administrative unit names. So are land users and owners of assets attached to land required to adjust the land use right certificates after the merger? And if there is a need to adjust, what steps should be taken, sir?

- According to the guidance of the Ministry of Agriculture and Environment in Official Dispatch No. 991, regarding the Certificates issued over the periods: After the arrangement of administrative units, it is not required to simultaneously adjust the issued Certificates, except in cases where land users and owners of assets attached to land have a need or are performing simultaneously with administrative procedures on land.

The adjustment of changes in land plot information (sheet number, plot number, address) on the issued Certificate of Land Use Rights is carried out in accordance with the provisions of Circular 10 dated July 31, 2024 of the Ministry of Natural Resources and Environment (now the Ministry of Agriculture and Rural Development) regulating cadastral records, land use right certificates, and ownership of assets attached to land. In case there are no more blank lines on the issued Certificate of Land Use Rights to confirm changes, a new Certificate will be issued to show the information of the land plot in accordance with the provisions of Decree No. 151 dated June 12, 2025 of the Government regulating the delimitation of authority of local authorities at 2 levels, decentralization, and decentralization in the land sector.

When there is a need to adjust information on the Certificate of Land Use Rights due to the merger of administrative units, people need to prepare a dossier including: Application for registration of changes in land and assets attached to land according to Form No. 18 issued with Decree No. 151 of the Government ; original copy of the issued Certificate of Land Use Rights; notarized or certified power of attorney (if submitting the dossier through a representative). The dossier is submitted to the Public Administration Service Center at the provincial and commune levels. The receiving agency will issue an appointment letter and transfer the dossier to the competent authority for processing.

The time for carrying out the procedure of adjusting information on the Certificate of Land Use Rights is no more than 5 working days from the date of receiving a complete and valid dossier. For communes in mountainous areas, islands, remote areas, and areas with difficult socio-economic conditions, the time for carrying out the procedure is no more than 10 working days.
