In the submission, the Ministry of Culture, Sports and Tourism stated that after more than 8 years of implementation, a number of provisions of the Press Law have revealed some limitations and inadequacies, failing to meet the practical requirements of press activities and the development of science , technology and communications.
In particular, there are shortcomings in the conceptual regulations that do not clearly distinguish between newspapers and magazines, leading to the situation where magazine agencies take advantage of the general functions and tasks of the press to operate as press agencies.
Regulations on conditions for granting press operation licenses apply to all subjects, leading to lax management and failure to assume the role of press management agency of social organizations and socio-professional organizations.
Journalism is a conditional profession, however there is no regulation requiring journalists to undergo training courses and professional ethics training before being granted a journalist card for the first time.
Besides, according to the Ministry of Culture, Sports and Tourism, current laws do not have regulations to form and develop large press agencies with sufficient resources to play a leading and information-orienting role.
In Vietnam, there are Voice of Vietnam (VOV), Vietnam Television (VTV) and Vietnam News Agency (VNA) organized according to the press consortium model, including a parent press agency (VOV, VTV, VNA) that publishes press products and affiliated press agencies (VOV e-newspaper, VTC Digital Television Station, VTV Times, Vietnam+ e-newspaper, Sports and Culture Newspaper, News Newspaper, Vietnam News Newspaper).
At the local level, a unified press agency model has been formed, such as the Quang Ninh Provincial Media Center or the Binh Phuoc Radio - Television and Newspaper Station, converging all four types of press.
Article 14 of the 2016 Press Law stipulates the subjects allowed to establish press agencies but does not clearly stipulate whether a press agency is allowed to be affiliated with another press agency, leading to difficulties in implementing the Press and Media Group model.
The drafting agency cited the conclusion of the Politburo in Notice 173/2005 of the Central Executive Committee on the information development strategy until 2010, which includes the content allowing the establishment of the model of "press group" and "publishing group".
However, the name needs to be considered appropriately. During the implementation process, it is necessary to do a pilot project, step by step, ensuring quality and effectiveness, not doing it massively and widely.
In the draft law, the Ministry of Culture, Sports and Tourism proposed adding the concept of a local press complex as an operating model of a local press agency with many types of press, affiliated press agencies, and a core role in orienting public opinion in the locality.
At the same time, the concept of a multimedia key press and media complex was added. This is an operating model of a press agency with many types of press, with affiliated press agencies, affiliated enterprises or capital contributions in enterprises, playing a core role in orienting public opinion, and having specific mechanisms on finance, labor, and wages like enterprises.
The subject operates according to the model of a multimedia press and communication complex in accordance with the Development Plan for the network of press, radio, television, electronic information, and publishing establishments approved by the Prime Minister.
The draft law also proposes that the Government stipulate in detail the specific financial, labor, and salary mechanisms of the main multimedia press and communication group; and the operating model of the local press group.
The Ministry of Culture, Sports and Tourism said it had received comments from 150 agencies, organizations and individuals. The drafting agency had studied, absorbed and explained the comments to complete the draft Press Law (amended).
