Ministry of Finance proposes to clarify the selection of contractors for the Ho Chi Minh City - Chon Thanh Expressway

The Ministry of Finance recently issued Document No. 10038/BTC-QLDT reporting to the Prime Minister and Deputy Prime Minister on the results of the inspection of contractor selection for the construction package of the Ho Chi Minh City - Thu Dau Mot - Chon Thanh Expressway Project through Binh Phuoc province.

Comprehensive review of contractor selection process

Previously, in Document No. 4755/VPCP-CN dated May 29, 2025, Deputy Prime Minister Tran Hong Ha directed the establishment of a joint working group of the Ministry of Finance - Ministry of Construction to organize the inspection of contractor selection for the construction package of the above Project, according to the principles of "fairness, objectivity, transparency and economic efficiency; ensuring the correctness of the policy of maximum decentralization for localities to decide, localities to do, localities to take responsibility".

On that basis, the Ministry of Finance issued Decision No. 1935/QD-BTC dated June 2, 2025 to establish an inspection task force, including representatives of the Ministry of Finance and the Ministry of Construction. Due to the urgent reporting deadline (before June 10, 2025), the task force can only conduct a direct inspection within 2 days in the locality. The bid package is large in scale, the bidding documents are complex, and many contractors participate, so the inspection process focuses on key contents: validity of bidding documents, evaluation of bidding documents, recommendations from contractors and contents related to construction equipment, materials, and capacity of the expert team.

However, due to the short implementation time and the need for more expert opinions on construction equipment inspection, the initial report of the Ministry of Finance only reflects the considerations and limitations but does not provide specific conclusions. This is to ensure the Government's spirit of decentralization - that is, for localities to consider, decide and take full responsibility for the contractor selection process.

The Ministry of Finance says that this implementation is completely consistent with the provisions of Clause 1 and Clause 3, Article 85 of the Law on Bidding. specifically, the Provincial People's Committee is responsible for organizing and managing bidding activities within its management scope, including inspection, examination, settlement of petitions, complaints, and handling of violations of the law.

By July 1, 2025, the Deputy Prime Minister continued to direct the Ministry of Finance to report more clearly, with specific conclusions and recommendations related to the inspected content.

Ensuring local accountability and transparent complaint resolution

To implement this direction, the Ministry of Finance has directed the Working Group to continue to review and evaluate more closely: Application of building information modeling (BIM); Construction machinery and equipment; Main materials used in construction; Capacity and experience of the expert team; Results of electronic bidding document evaluation (E-HSDT) and the process of submitting results for approval.

Since then, the Ministry of Finance has issued Document No. 10038/BTC-QLDT reporting to the Prime Minister and Deputy Prime Minister, with more specific assessments and conclusions on the results of the inspection of contractor selection for the construction package of the Ho Chi Minh City - Thu Dau Mot - Chon Thanh Expressway Project through Binh Phuoc province.

Based on the results of this inspection, the Ministry of Finance has recommended that the Government leaders direct the People's Committee of Dong Nai province on a number of contents.

First, absorb the comments indicated in the report of the Ministry of Finance to review the entire contractor selection process. If necessary, hire an independent consulting unit with sufficient capacity and experience to re-conduct the evaluation process.

If the results of the re-evaluation of the electronic bidding documents (E-HSDT) show that the winning bidder is no longer suitable, or all bidders do not meet the requirements, the Provincial People's Committee must take measures to not recognize the contractor selection results according to Article 18 of the Bidding Law. Depending on the situation, the locality can re-organize the bidding or approve new results.

On the contrary, if the re-evaluation results do not change the original results, the investor must quickly sign the contract and start construction. In all cases, the selected contractor must fully meet the criteria of capacity, experience, technical solutions, progress, finance and quality.

Second, the People's Committee of Binh Phuoc province is fully responsible for the entire process of selecting contracts in accordance with the spirit of decentralization "local decision, local action, local responsibility" as directed by the Government.

Third, if required, the Provincial People's Committee can discuss with the Ministry of Construction or relevant ministries and branches to clearly define the requirements for technical safety and environmental protection inspection documents of construction equipment, ensuring legality and completeness according to legal regulations.

Fourth, the handling of the petition of the Son Hai contractor must be carried out seriously, objectively, and in accordance with legal regulations. The handling of the petition must be decided, avoid prolongation and affect the progress of the project implementation.
