The Ministry of Industry and Trade does not accept the commitment in the investigation case of applying anti-dumping measures on some hot-rolled steel products originating from the Republic of India and the People's Republic of China.

On July 4, 2025, the Ministry of Industry and Trade issued Decision No. 1958/QD-BCT on not accepting the commitment in the investigation case of applying anti-dumping measures on some hot-rolled steel products originating from the Republic of India and the People's Republic of China (case code AD20).

Pursuant to Articles 77 and 81 of the Foreign Trade Management Law, on June 6, 2025, the Ministry of Industry and Trade received a commitment proposal from the China Iron and Steel Association - CISA representing 16 Chinese manufacturing and exporting enterprises.

Based on CISA's proposed commitment, the Ministry of Industry and Trade has sent a document requesting the Ministry of Finance (Customs Department) and relevant parties to comment on CISA's proposed price commitment as well as the mechanism for controlling and monitoring minimum prices and import volumes as proposed by CISA.

Based on the opinions of the relevant parties and the Ministry of Finance, the Ministry of Industry and Trade determined not to accept the commitment proposal of CISA for the following reasons: (i) only the requesting party that has fully cooperated during the investigation phase will be considered for the commitment; (ii) the maximum commitment amount is not capable of overcoming the significant damage to the domestic industry; (iii) the minimum commitment price is not capable of overcoming the significant damage to the domestic industry; (iv) the reference price is not public, causing difficulties in comparison and monitoring; (v) there is no current management mechanism of the Customs Authority that can effectively monitor the implementation of the commitment; (vii) the application of the commitment without a management and supervision mechanism can lead to the possibility of evading anti-dumping measures and (viii) the application of the commitment is not capable of overcoming the significant damage to the domestic industry.
