My locality is merging primary and secondary schools. According to the explanation of the Department of Internal Affairs, the principal and vice principal of the primary school after the merger are not qualified to continue working as managers at primary and secondary schools.
The reason is that Clause 3, Article 11 of Circular No. 32/2020/TT-BGDDT dated September 15, 2020 of the Minister of Education and Training stipulates that the training level and working time must meet the standard training level of teachers according to the provisions of the Law on Education for the level of education, meet the standard training level at the highest level for general schools with many levels of education and have taught for at least 5 years (or 4 years for mountainous areas, islands, highlands, remote areas, ethnic minority areas, areas with especially difficult socio-economic conditions) at that level of education.

The standards for principals and vice principals of multi-level general schools are stipulated in Clause 3, Article 11 of Circular No. 32/2020/TT-BGDDT, specifically as follows: Having at least 5 years of teaching experience (or 4 years for mountainous areas, islands, remote areas, ethnic minority areas, and areas with particularly difficult socio -economic conditions) at that level, meeting the standard training level of teachers according to the provisions of the Law on Education for the level, and meeting the standard training level at the highest level if it is a multi-level general school.
According to Conclusion No. 137-KL/TW dated March 28, 2025 of the Politburo guiding the arrangement and reorganization of administrative units at all levels and the construction of a two-level local government model, the reorganization of public service units is carried out in the direction of: Maintaining educational and health service units and transferring to commune-level authorities the management of secondary schools, primary schools, kindergartens, and medical stations of the new grassroots units.
In Official Dispatch No. 1581/BGDĐT-GDPT dated April 8, 2025 of the Ministry of Education and Training guiding localities in implementing State management of education when implementing the two-level local government model. Accordingly, public kindergartens, primary schools and secondary schools are maintained and transferred to commune-level authorities for management.
While the Ministry of Education and Training is studying to amend Circular No. 32/2020/TT-BGDDT, in order to ensure the stability of the management team and maintain smooth educational activities when implementing the arrangement of administrative units according to Conclusion No. 137-KL/TW dated March 28, 2025, the Ministry requests the Department of Education and Training to advise the Provincial People's Committee and coordinate with relevant departments and branches to maintain the status quo of public service units in the field of education.
