Removing legal 'bottlenecks', unlocking resources for national development

(Chinhphu.vn) - Innovation in law-making and enforcement, and removing bottlenecks caused by legal regulations, is identified as a key and urgent task in 2025, with a proactive, drastic, and synchronous spirit, aiming to create an open legal environment, promote innovation and socio-economic development.

On July 4, the Ministry of Justice held a meeting with industry associations, corporations, and large enterprises to listen to their feedback on difficulties and obstacles caused by legal regulations in production and business activities and propose solutions.

This is a concrete activity to implement Resolution No. 66-NQ/TW of the Politburo on innovation in law-making and enforcement to meet the requirements of national development in the new era.

Clearly identify the focus, proactively remove obstacles

At the meeting, Deputy Minister of Justice Nguyen Thanh Tu emphasized that Resolution No. 66-NQ/TW dated April 30, 2025 of the Politburo set the goal for 2025: " basically completing the removal of "bottlenecks" due to legal regulations ", with the task and solution: "Innovating thinking and orienting law-making in the direction of both ensuring state management requirements and encouraging creativity, liberating all productive forces, and unlocking all development resources".

This spirit continued to be concretized at the First Session of the Central Steering Committee on Institutional and Legal Improvement chaired by General Secretary To Lam on June 5, 2025. The General Secretary requested to focus on reviewing and removing contradictory, overlapping, unreasonable, unfeasible, and unclear regulations that create different interpretations in the legal system. This is not only an urgent task but also a political imperative, aiming to shift from "management" to "development creation" thinking...

Based on that orientation, the Central Steering Committee issued Plan No. 04-KH/BCĐTW dated June 10, 2025 to direct the work of reviewing and removing difficulties caused by legal regulations. The plan aims to specifically identify tasks, priority areas, deadlines and responsibilities of relevant agencies and members; at the same time, it clearly indicates that the focal advisory agency is the Ministry of Justice.

Ms. Nguyen Thi Thu Hoe, Deputy Director of the Department of Document Inspection (Ministry of Justice) said that the Plan includes 8 groups of work, divided into 3 large areas, which are: Building a Resolution of the National Assembly on the mechanism for handling legal problems; reviewing and proposing to improve general laws; reviewing specialized topics in the fields of finance - investment and science - technology, innovation, digital transformation.

On June 24, at the 9th Session, the National Assembly passed a Resolution of the National Assembly on a special mechanism to handle difficulties and obstacles caused by legal regulations. After the Resolution was issued, the Ministry of Justice is coordinating with ministries, branches and localities to guide its implementation, focusing on correctly identifying legal bottlenecks.

Regarding sources, the subjects requesting opinions to review and reflect "bottlenecks" have 6 main sources, including: Ministries, branches; localities; Business associations; corporations, large enterprises; inspection, examination, investigation, auditing agencies, lawyers, arbitrators and the system of reflecting legal problems through the National Law Portal.

Three main solutions were proposed: Explaining and guiding the application of the law; amending key laws such as the Land Law and the Planning Law; issuing normative resolutions of the Government and the National Assembly Standing Committee.

Review the topic: Removing obstacles for investment, innovation, digital transformation

In addition to reviewing and proposing solutions to improve general laws, the Central Steering Committee on improving institutions and laws also requires reviewing and handling two specific topics in the fields of finance and investment; science, technology, innovation and digital transformation.

Regarding finance and investment, the Party Committee of the Ministry of Finance is assigned to take the lead in continuing to perfect the law throughout 2025, focusing on the Law on Planning and the Law on Investment. The Ministry can also apply specific mechanisms from the new Resolution to handle legal problems.

Regarding science, technology, innovation and digital transformation, the Party Committee of the Ministry of Science and Technology presided over the review. Although the National Assembly is about to pass a number of new laws, there are still regulations that have not kept up with reality, requiring continued updating and supplementation of laws such as the Intellectual Property Law, the High Technology Law, the Technology Transfer Law and the construction of a new Law on Digital Transformation.

In addition to the two thematic review groups mentioned above, the Ministry of Justice and the Ministry of Home Affairs are reviewing and evaluating the implementation of laws on decentralization, delegation, and assignment of authority and solutions to handle shortcomings and problems. The Ministry of Justice and relevant agencies (review and propose solutions to improve laws on preventing and combating corruption, waste, and negativity).

At the meeting, representatives of associations and large enterprises frankly shared about the difficulties in production and business practices due to legal problems. Many opinions said that there are still contradictory regulations, overlapping between laws, or unclear, causing difficulties for enterprises when implementing projects. In addition, some regulations have not kept up with the rapid development of the market, technology, new business models, increasing compliance costs and legal risks...

Delegates also suggested that there should be a more flexible mechanism in handling problems arising from practice, increasing consultation with businesses in the law-making process, and improving the efficiency of the system for receiving, reflecting, and recommending legal regulations to ensure effective and timely interaction between the State and people and businesses.
