Latest Government Regulations on National Universities

TPO - According to the latest regulations of the Government, national universities are public higher education institutions managed by the Ministry of Education and Training, have legal status, have their own accounts and use seals with the national emblem. This is a new point compared to Decree 186 on national universities issued by the Government in 2013.

The Prime Minister has just signed and issued Decree 201 regulating the functions, tasks and powers of national universities (VNUs), replacing Decree No. 186/2013/ND-CP dated November 17, 2013 of the Government on VNUs.

According to Decree 201, the National University has the duties and powers prescribed in the Law on HigherEducation and other provisions of law.

VNU is a public higher education institution managed by the Ministry of Education and Training, has legal status, has its own account and uses a seal with the national emblem.

This is also a new point compared to Decree 186 and the authority of the Ministry of Education and Training is increased. National universities are under the Ministry of Education and Training when the Decree takes effect (from September 1).

Before Decree 201, VNU was under the management of the Government, under the state management of the Ministry of Education and Training on education and training, and under the management of the Ministry of Science and Technology on science and technology...

Regarding the organization and personnel, VNU carries out the personnel work process to report to the Ministry of Education and Training to submit to the Prime Minister for appointment and dismissal of the Chairman of the National University Council; the director and deputy director of VNU according to regulations; submit to the Ministry of Education and Training for recognition of the National University Council according to regulations. This regulation clearly shows the role of the Ministry of Education and Training - not included in Decree 186.

No change in national university autonomy

However, the autonomy of VNU remains unchanged, and is positioned by the Government as one of the strategic hubs of higher education, responsible for coordinating and ensuring connectivity between member units, affiliated units and subordinate units.

The National University is issued regulations on the working regime of lecturers and researchers in accordance with the law applicable to the National University to attract and promote high-quality human resources domestically and internationally. The Decree also stipulates that the National University is given the initiative in using human resources to ensure the needs of teaching, scientific research and business administration.

Regarding training, VNU is proactive in developing training regulations for all levels of university education with the goal of developing and improving the quality of university education to train highly qualified human resources; promoting international cooperation and integration.

VNU is proactive in developing and implementing practical, specialized, special, gifted and talented training programs at all training levels to discover, train and foster scientific and technological talents; implementing training programs that have been implemented domestically abroad through international cooperation and association programs.

Regarding science, technology and innovation activities, VNU proposes and implements national science and technology programs; is one of the focal points for research and provides scientific arguments. VNU organizes science and technology activities in all scientific fields to promote the development of science, technology and innovation associated with training high-quality human resources and nurturing science and technology talents.

Regarding financial work, VNU is a level I budget unit assigned by the Prime Minister to budget estimates; implement unified management of budget allocation and assignment to member units, units under and directly under VNU, and is responsible for accounting and budget settlement of the national university according to current regulations of the law on state budget.

The latest government decision does not change the autonomy of national universities.

National Universities are regulated to collect tuition fees in National Universities according to Government regulations.

The Decree also clearly states that the National University manages, operates, uses and shares financial resources, human resources, facilities and other resources assigned throughout the National University, ensuring organic, synchronous and effective nature; mobilizing social resources to build the National University into a research-oriented higher education institution of regional and international stature.

The National University works directly with ministries, ministerial-level agencies, government agencies, People's Committees of provinces and centrally-run cities to resolve issues related to national universities...

Currently, Vietnam has two national universities: VNU-HCM and VNU-Hanoi. According to Decision No. 452 approving the planning of the network of higher education and pedagogical institutions for the period 2021-2030, with a vision to 2050, in the near future, Vietnam will have additional VNU-Hue and VNU-Da Nang.
