No national funeral for key leaders disciplined or removed from office

The Government has just issued Decree No. 237/2025 amending and supplementing a number of articles of Decree No. 105/2012 dated December 17, 2012 of the Government on organizing funerals for cadres, civil servants and public employees.

New regulations on funeral organization for officials, civil servants and public employees

Accordingly, when officials, civil servants, and public employees who are working or retired pass away, their funerals will be organized according to one of the following rituals: National funeral; State funeral; High-level funeral; Funeral for officials, civil servants, and public employees. Changes to funeral rituals other than those specified in this Decree shall be implemented according to regulations of competent authorities.

Regulations on organizing funerals for retired or dismissed officials due to violations

The notable point of Decree No. 237/2025 is the amendment and supplementation of a number of clauses of Article 5 of Decree No. 105/2012 on the positions that are allowed to organize state funerals. This includes the addition of regulations on cases of dismissal from office due to violations and shortcomings.

Specifically: In the case of a deceased person holding one of the positions of General Secretary; President; Prime Minister; Chairman of the National Assembly , who is dismissed from office, retired from work, retired before the prescribed age, or retired according to regulations due to violations or shortcomings, the funeral will be held according to high-level funeral rites.

The Decree also amends and supplements regulations on positions that are entitled to hold state funerals for officials who are holding or have ceased to hold one of the following positions upon their death. Including: Politburo member, Secretary of the Party Central Committee; Vice President; Deputy Prime Minister; Vice Chairman of the National Assembly; Chairman of the Central Committee of the Vietnam Fatherland Front; Chief Justice of the Supreme People's Court; Chief Prosecutor of the Supreme People's Procuracy ; General of the People's Armed Forces; Senior Lieutenant General of the People's Armed Forces who were revolutionary cadres before the August 1945 Uprising.

In the case of a deceased person holding one of the above-mentioned positions who is dismissed from his/her position, retired from work, retired before the prescribed age, or retired according to regulations due to violations or shortcomings by a competent authority, the funeral will be organized according to high-level funeral rites; if disciplined by dismissal or removal of position or title, the funeral will be organized according to funeral rites for cadres, civil servants, or public employees.

For positions that are allowed to organize high-level funerals, the decree amends and supplements Article 34 of Decree No. 105/2012/ND-CP in cases such as incumbent officials and civil servants who have ceased to hold positions under the management of the Politburo and the Central Party Secretariat (except for positions that are allowed to organize national funerals and state funerals).

Revolutionary cadres who participated in revolutionary activities before January 1, 1945 (revolutionary veterans) were awarded the Independence Medal, first class or higher; cadres who participated in the South during the anti-American resistance period (1954 - 1975) were awarded the Independence Medal, first class or higher; outstanding social, cultural and scientific activists (awarded the Ho Chi Minh Prize - individual award) were awarded the Independence Medal, first class or higher; outstanding social, cultural and scientific activists (awarded the Ho Chi Minh Prize - individual award) were Heroes of the People's Armed Forces, Heroes of Labor who were working or retired and passed away were given a high-level funeral.

In the case of a deceased person holding one of the above positions who is disciplined by dismissal or removal of position or title, the funeral will be organized according to the funeral rites for cadres, civil servants, and public employees.

In the case of a deceased member of the Party Central Committee (except for positions for which a state funeral and a state funeral are held) who is dismissed from office, retired from work, retired before the prescribed age, or retired according to regulations due to violations or shortcomings, the funeral will be held according to the funeral rites for cadres, civil servants, and public employees.
