Delegating initiative to the education sector in recruiting and using teachers

The Draft Law on Teachers is being submitted to the National Assembly for its first review at the 8th Session of the 15th National Assembly. One of the proposed new points of the Draft Law on Teachers is to give theeducation sector the initiative in recruiting and using teachers.


Managing teachers based on administrative factors is no longer appropriate.

According to the program of the 8th Session of the 15th National Assembly , on November 9, the draft Law on Teachers will be submitted to the National Assembly for first comments.

The Draft Law on Teachers is expected to create a breakthrough in building and developing the teaching staff, starting with changes in State management of teachers.

Compared with other human resources of the country, the teaching staff has distinct characteristics and high diversity, which determines the orientation of State management of teachers.

According to the Ministry of Education and Training, there are currently nearly 1.6 million teachers nationwide. Thus, teachers account for a large number of the country's total human resources, especially the country's intellectuals; accounting for the highest proportion of the total number of civil servants in all sectors and fields.

Teachers have special professional activities with the product being the personality of the learner. With the goal of development and with the unique but very diverse characteristics of teachers, the State management of teachers in the direction of personnel management - that is, managing administrative factors related to the use of teachers with little attention to the potential and development of teachers is not a suitable method.

Instead, many opinions suggest that it is necessary to shift from personnel management to human resource management to create an environment and conditions for each teacher to develop the most, have the greatest motivation to work, contribute the most to education and training to achieve the same goals of the teacher himself and the educational goals. In which teachers, both public and private, see themselves, their profession, their mission, their advancement path to clearly orient their training and development.

To address the above requirements, the Teachers Law project proposes to give the education sector the initiative in recruiting and using teachers.

In which, the Ministry of Education and Training (MOET) and the Ministry of Labor, War Invalids and Social Affairs are the agencies in charge of developing strategies, projects, development plans, and total staffing of teachers under their management authority to submit to competent authorities for decision; promulgate recruitment criteria and standards, pedagogical practice content in teacher recruitment exams/examinations; and coordinate the staffing of teachers in public educational institutions according to the number assigned by competent authorities.

According to many experts, the above regulations aim to strengthen the leading role of educational management agencies in state management of teachers, in order to help the education sector be proactive in managing and developing the teaching staff. This is consistent with the guiding viewpoint of the Politburo in Conclusion No. 91-KL/TW dated August 12, 2024 on continuing to fundamentally and comprehensively innovate education and training.

In addition, with the above-mentioned proactive authority, the State management agency of education can manage the teaching staff with expertise and quality, instead of managing with administrative tools that are not suitable for the professional characteristics of this group.

Professional management tools will help standardize the quality of teachers, thereby helping to improve the quality of the entire education system.

In addition, the regulations on State management of teachers designed in the Teachers Law project will also help to resolve many current shortcomings in State management of teachers, such as the situation of local surplus and shortage of teachers for preschool and general education levels that has been happening for many years, and the shortcomings in the management of non-public teachers...

Assign responsibility and initiative in recruiting and using teachers

Sharing about the current state management of teachers in the locality, Prof. Dr. Thai Van Thanh - Director of the Department of Education and Training of Nghe An province, a delegate of the 15th National Assembly, acknowledged that the current state management of teachers has revealed a number of difficulties and limitations in planning for staff development, selection, use, management, training, fostering, evaluation, classification, and implementation of preferential treatment for teachers.

From the perspective of the current situation of managing the teaching staff, Mr. Thanh proposed that it is necessary to assign responsibility and initiative in recruiting and using teachers to educational management agencies; at the same time, he also proposed solutions for State management of teachers.

In particular, planning the teaching staff needs to ensure consistency and long-term, ensuring the initiative of educational management agencies at all levels. At the same time, innovating the work of recruiting and appointing teachers.

Regarding recruitment, Mr. Thanh proposed to regulate the content, form and requirements on conditions and recruitment standards specifically for teachers, to ensure that they are suitable for the characteristics of teachers' profession, minimize administrative and public service requirements, and increase requirements and assessments of pedagogical capacity.

According to Mr. Thanh, it is necessary to build a working environment for teachers that ensures conditions of facilities, pedagogical environment, educational environment, and safety for teachers in performing their duties.

Expecting that the draft Law on Teachers will be submitted to the 15th National Assembly for its first comments at the 8th Session, the Director of the Department of Education and Training of Nghe An province said that this will be the basis for enhancing the position and role of teachers, creating motivation for them to work with peace of mind, making many contributions and dedication to the cause of educating people. The draft Law on Teachers has initially created an exciting atmosphere for more than 1.6 million teachers; receiving consensus and support from parents and the people.
