The Minister of Justice has just signed and issued Decision No. 1898/QD-BTP stipulating the functions, tasks, powers and organizational structure of the Civil Judgment Enforcement Management Department (CJD). This not only marks an important change in the organization of the civil judgment enforcement sector but also clearly concretizes the Party's major policy on streamlining the apparatus, operating effectively and efficiently.
New structure and organization of the THADS Management Department
According to the Decision: At the Central level, the organizational structure of the THADS Management Department includes: Legal and THADS Operations Department; Administrative and Bailiff Enforcement Operations Department; Inspection, Complaints and Denunciations Department; Digital Transformation and Enforcement Data Statistics Department; Planning and Finance Department; Personnel Organization Department; Office.
At the local level, the organization under the local department includes: 34 provincial and municipal THADS, including 355 regional THADS Offices, other offices and equivalents according to the decision of the Minister of Justice.
Provincial and municipal THADS have legal status, have seals with the national emblem, and have their own accounts at the State Treasury and commercial banks in accordance with the law.
The General Department of THADS will continue to operate until the THADS Management Department officially operates from July 1, 2025. The Director General of the General Department of THADS is responsible for advising, directing, and organizing the implementation of necessary preparations for the THADS Management Department to officially come into operation.
The Minister of Justice issued a Decision regulating the functions, tasks, powers and organizational structure of the Department of THADS Management, institutionalizing and strictly implementing the Party's policy on streamlining the apparatus, operating effectively and efficiently; it is a strong and unprecedented innovation plan for THADS agencies associated with transforming the management, direction and organization of THADS; at the same time, comprehensively restructuring the staff, aiming to build a staff with sufficient qualities, capacity, courage, equal to the task, with more advantages as well as overcoming many limitations of the previously submitted plan.
Streamlining the apparatus of local THADS agencies
According to the Project "Continuing to arrange and streamline the civil judgment enforcement system to ensure effective and efficient operations" of the Party Committee of the Ministry of Justice (issued with Official Dispatch No. 310-CV/DU dated June 25, 2025 of the Party Committee of the Ministry of Justice), changing the structure and organizational model of the Civil Judgment Enforcement Management Department has the following outstanding advantages:
First of all, this is a thorough implementation of the innovation policy of the "Revolution in streamlining and streamlining the organizational apparatus" in the current period.
The organization of the local THADS agency is more streamlined, reduced by one level, contributing to restructuring the staff, further specializing the civil servant team, thereby improving the effectiveness of THADS work.
Regarding management, the Head of the provincial THADS agency directly and consistently manages personnel and enforcement activities throughout the province, especially for Enforcement Officers. The resolution of problems and professional guidance for Enforcement Officers are carried out more quickly, effectively, and consistently without having to go through the regional THADS agency.
The leaders of the Regional THADS Department do not make decisions on execution of judgments, do not manage funds and evidence for execution of judgments, so they will be more focused and have more time to direct the organization of THADS, overcoming the limitations and violations in the past due to weaknesses in financial management and direction of a part of the leaders at the Branch level.
In addition, the organization of civil judgment enforcement is smoother and faster because there is no longer a delegation of civil judgment enforcement between regions within each province.
Unifying the management and control of THADS activities facilitates the inspection, statistics, monitoring and reporting of execution data. Reducing the number of financial and asset management agencies contributes to more effective management, is a measure to reduce corruption and negativity...
