Streamline the organization to be lean and efficient
Minister of Justice Nguyen Hai Ninh has just signed and issued Decision No. 1898/QD-BTP stipulating the functions, tasks, powers and organizational structure of the Civil Judgment Enforcement Administration (CEA). According to the new decision, the organizational structure of the CEA is reorganized in a more scientific, streamlined and specialized direction:
At the central level, the Department consists of 7 specialized units: Legal Affairs and Civil Judgment Enforcement Department; Administrative Judgment Enforcement and Bailiff Department; Inspection, Complaints and Denunciations Department; Digital Transformation and Judgment Enforcement Data Statistics Department; Planning and Finance Department; Personnel Organization Department; and Office.
At the local level, the system includes 34 provincial and municipal THADS agencies, directly managing 355 regional THADS Offices. Provincial THADS agencies are granted full legal status, have their own national seals and accounts at the State Treasury and commercial banks.
The new model has eliminated the intermediate level (district-level branches), while increasing the initiative and responsibility of provincial-level THADS agencies in managing organization, personnel and operations throughout the area.
The Minister of Justice issued a Decision regulating the functions, tasks, powers and organizational structure of the Civil Judgment Enforcement Management Department, institutionalizing and strictly implementing the Party's policy on streamlining the apparatus, operating effectively and efficiently; it is a strong and unprecedented innovation plan for civil judgment enforcement agencies associated with transforming the management, direction and operation methods, and organizing civil judgment enforcement.
At the same time, comprehensively restructure the staff, aiming to build a staff with sufficient qualities, capacity, courage, equal to the task, with more advantages as well as overcoming many limitations of the previously presented plan.
Towards a modern and effective judiciary
According to the Project "Continuing to arrange and streamline the apparatus of the THADS System to ensure effective and efficient operation" of the Party Committee of the Ministry of Justice, the new model has many outstanding advantages, contributing to improving the quality and efficiency of execution of judgments: The issuance of the Decision to establish the THADS Management Department has thoroughly implemented the innovation policy of the "Revolution in arranging and streamlining the organizational apparatus" in the current period.
The restructuring of the apparatus according to the new model has streamlined an intermediate level, increased specialization, thereby improving the quality of civil servants and the effectiveness of enforcement. The provincial THADS agency now assumes the role of direct and comprehensive direction in both personnel organization and operations in the area, helping to promptly handle difficulties and problems arising in practice, especially for the activities of the Enforcement Officer.
At the same time, the new model clearly separates administrative and professional management functions. The leaders of the regional THADS Department no longer perform the tasks of financial and asset management and issue enforcement decisions, thereby creating conditions to focus on professional direction and minimizing errors due to limitations in previous management capacity.
Organizing the apparatus in a new direction also helps shorten the business process, when eliminating the mechanism of delegation between regions within the same province, thereby improving the speed and efficiency of execution. Along with that, concentrating the focal point of financial and asset management at the provincial level not only increases the effectiveness of inspection and supervision but is also an effective measure to prevent and combat corruption and negativity.
In the context of no longer having district-level authorities, the new model creates favorable conditions for provincial THADS agencies to coordinate directly and effectively with provincial agencies in enforcement, verification, and removal of difficulties and obstacles. The concentration of resources, staffing, and workload at the provincial level also gradually enhances the position of THADS agencies, approaching the role and functions of agencies at the Department level, contributing to enhancing the effectiveness of inter-sectoral coordination and law enforcement at the local level.
The decision to reorganize the Civil Judgment Enforcement Department is not only an administrative technical requirement but also a clear demonstration of the strategic orientation of the Ministry of Justice in building a streamlined, effective and efficient civil judgment enforcement system.
