Delimitation of authority of 2 levels of government in the state management field of the Ministry of Education and Training
The Government issued Decree No. 142/2025/ND-CP regulating the division of authority of two-level local authorities in the field of state management of the Ministry of Education and Training.
According to the Decree, the authority to establish or permit the establishment, permiteducational activities, suspend educational activities, merge, divide, separate, and dissolve public, private, and non-public nurseries, kindergartens, and preschools prescribed in Clause 1, Article 4, Clause 1, Article 6, Clause 2, Article 7, Clause 2, Article 8, and Clause 2, Article 9 of Decree No. 125/2024/ND-CP of the Government regulating conditions for investment and operation in the field of education is exercised by the Chairman of the People's Committee at the commune level.
The authority to convert private kindergartens invested by foreign investors and ensuring operating conditions specified in Point b, Clause 2, Article 6 of Decree No. 84/2020/ND-CP of the Government detailing a number of articles of the Law on Education is implemented by the Chairman of the Provincial People's Committee.
The authority to convert private kindergartens invested by domestic investors and ensuring operating conditions specified in Point b, Clause 2, Article 6 of Decree No. 84/2020/ND-CP is exercised by the Chairman of the People's Committee at the commune level.
The authority to establish or permit the establishment, permit educational activities, suspend educational activities, merge, divide, separate, and dissolve public and private primary schools as prescribed in Clause 1, Article 16, Clause 1, Article 18, Clause 2, Article 19, Clause 2, Article 20, and Clause 2, Article 21 of Decree No. 125/2024/ND-CP is exercised by the Chairman of the People's Committee at the commune level.
The authority to establish or permit the establishment, permit educational activities, suspend educational activities, merge, divide, separate, or dissolve junior high schools and multi-level general schools with the highest level being junior high school as prescribed in Clause 1, Article 26, Clause 1, Article 28, Clause 2, Article 29, Clause 2, Article 30, and Clause 2, Article 31 of Decree No. 125/2024/ND-CP is exercised by the Chairman of the People's Committee at the commune level.
The authority to establish or permit the establishment, merger, division, separation, or dissolution of high schools and multi-level general schools with the highest level being high school as prescribed in Clause 1, Article 26, Clause 2, Article 30, and Clause 2, Article 31 of Decree No. 125/2024/ND-CP shall be exercised by the Chairman of the Provincial People's Committee.
The authority to permit educational activities and suspend educational activities for high schools and multi-level general schools with the highest level being high school as prescribed in Clause 1, Article 28 and Clause 2, Article 29 of Decree No. 125/2024/ND-CP is exercised by the Director of the Department of Education and Training.
The authority to convert private primary schools, private secondary schools and private general schools with multiple levels of education, the highest level of which is secondary school, invested by domestic investors and ensuring the operating conditions specified in Point b, Clause 2, Article 7 of Decree No. 84/2020/ND-CP is exercised by the Chairman of the People's Committee at the commune level.
The authority to convert private high schools, multi-level private schools with the highest level being high school invested by domestic investors and ensuring operating conditions and private general education institutions invested by foreign investors and ensuring operating conditions as prescribed in Point b, Clause 2, Article 7 of Decree No. 84/2020/ND-CP shall be implemented by the Chairman of the Provincial People's Committee.
This Decree comes into force from July 1, 2025.

Authority to perform state management tasks of local authorities at 2 levels in the field of education
The Ministry of Education and Training issued Circular 13/2025/TT-BGDDT regulating the decentralization, delegation and assignment of authority to perform state management tasks of two-level local authorities in the field of education.
Accordingly, the authorities exercised by the People's Committee at the commune level include: Managing the use of diploma and certificate blanks and being responsible for the issuance of diplomas and certificates; organizing the reception and examination of external assessment registration dossiers, sending accepted external assessment registration dossiers to the Department of Education and Training for primary schools; organizing the implementation of regulations on educational quality assessment and recognition of national standards for primary schools;
Organize the reception and examination of external assessment registration dossiers, send accepted external assessment registration dossiers to the Department of Education and Training for secondary schools and general schools with multiple levels of education, with the highest level being secondary school; organize the implementation of regulations on educational quality assessment and recognition of national standards for secondary schools;
Organize the reception and examination of external assessment registration dossiers, send accepted external assessment registration dossiers to the Department of Education and Training for preschools; organize the implementation of regulations on educational quality assessment and recognition of national standards for preschools;
Collect and summarize the results of school safety assessment, accident and injury prevention for schools under its management authority; direct, guide and inspect the organization of physical assessment and classification for students at educational institutions under its management; organize the implementation of regulations on the Red Cross in schools;
Guide and deploy the organization of activities and use of email and electronic information portals; include the content of building, upgrading, managing and operating the email system and electronic information portal in the annual work plan; report the results of implementing the organization of activities and use of email and electronic information portals as prescribed in Circular No. 37/2020/TT-BGDDT; organize inspection, assessment and ranking of the operation of email systems and electronic information portals of affiliated educational institutions; publicly announce the results on the electronic information portal;
Organize the implementation of regulations on subject classrooms; evaluate and recognize libraries of kindergartens, primary schools, secondary schools and multi-level general schools; organize the implementation of regulations on library standards for preschool and general education institutions.
Organize the implementation of regulations on funding for educational institutions in the national education system; direct, inspect and supervise primary and secondary schools; guide and urge the implementation of reporting and data management within the scope of management on the basis of education and training databases.
This Circular takes effect from July 1, 2025.
This Circular ceases to be effective from March 1, 2027, except for cases where laws, resolutions of the National Assembly, ordinances, resolutions of the National Assembly Standing Committee, decrees, resolutions of the Government, decisions of the Prime Minister, Circulars of the Minister of Education and Training have provisions on the authority, responsibility for state management, order and procedures prescribed in this Circular approved or issued from July 1, 2025 and take effect before March 1, 2027, then the corresponding provisions in this Circular cease to be effective at the time such legal documents take effect.
During the effective period of the provisions of this Circular, if the provisions on authority, state management responsibilities, order and procedures in this Circular are different from relevant legal documents issued before July 1, 2025, the provisions of this Circular shall apply.

Authority to perform state management tasks of local authorities at 2 levels with preschool education
The Ministry of Education and Training issued Circular No. 09/2025/TT-BGDDT dated June 12, 2025 on decentralization, delegation and assignment of authority to perform state management tasks of two-level local authorities for preschool education.
According to this Circular, replace the authority or phrase "District-level People's Committee and name of district-level unit", "Department of Education and Training", "District-level People's Committee" with "Commune-level People's Committee" in Article 5, Clause 1, Article 6 of the Preschool Charter issued with Circular No. 52/2020/TT-BGDDT.
Replace the authority or phrase "Chairman of the District People's Committee" with "Director of the Department of Education and Training" in Clause 1, Article 6, Article 9, Article 10 of Circular No. 52/2020/TT-BGDDT.
The authority to guide state management of education for the People's Committees at the commune level and guide and organize professional implementation for independent preschools prescribed in Clause 3 and Clause 4, Article 22 of the Regulations on organization and operation of independent nursery groups, independent kindergarten classes, independent preschool classes of non-public and private types issued together with Circular No. 49/2021/TT-BGDDT implemented by the Department of Education and Training.
Replace the phrase "Department of Education and Training" with the phrase "Commune-level People's Committee" in Article 21, title of Article 22; the phrase "Department of Education and Training" with the phrase "Department of Education and Training" in Clause 1, Article 23; the phrase "District-level People's Committee" with the phrase "Provincial-level People's Committee" in Clause 7, Article 22 and Clause 4, Article 23 of Circular No. 49/2021/TT-BGDDT, except for the provisions in Clause 1 of this Article.
Remove the phrase "District People's Committee and" in Clause 8, Article 22 of Circular No. 49/2021/TT-BGDDT.
Replace the authority or phrase "Department of Education and Training" with the phrase "Commune-level People's Committee" in Article 13 and Article 14 of Circular No. 47/2020/TT-BGDDT regulating the selection of toys and learning materials used in preschool education institutions.
Replace the authority or phrase "Department of Education and Training" with the phrase "Commune-level People's Committee" in Articles 9, 10, 11, and 12 of Circular No. 45/2021/TT-BGDDT regulating the construction of safe schools and prevention of accidents and injuries in preschools.
Replace the authority or phrase "Department of Education and Training" with the phrase "Commune-level People's Committee" in Article 14 and Article 15 of Circular No. 30/2021/TT-BGDDT regulating the compilation, appraisal, approval and selection of documents for use in preschool education institutions.
The authority to guide the English familiarization program for preschool children is specified in Clause 3, Section VII of the English familiarization program for preschool children issued with Circular No. 50/2020/TT-BGDDT, implemented by the Department of Education and Training.
Replace the authority or phrase "Department of Education and Training" with the phrase "Commune-level People's Committee" in Clause 3, Section VII of Circular No. 50/2020/TT-BGDDT, except for the provision in Clause 1 of this Article.
The authority to guide the implementation of the Preschool Education Program prescribed in Clause 1, Part Four of the Preschool Education Program issued together with Circular No. 17/2009/TT-BGDDT has been amended and supplemented by Circular No. 28/2016/TT-BGDDT and Circular No. 51/2020/TT-BGDDT implemented by the Department of Education and Training.
This Circular takes effect from July 1, 2025.
This Circular ceases to be effective from March 1, 2027, except for cases where laws, resolutions of the National Assembly, ordinances, resolutions of the National Assembly Standing Committee, decrees, resolutions of the Government, decisions of the Prime Minister, Circulars of the Minister of Education and Training have provisions on the authority, responsibility for state management, order and procedures prescribed in this Circular approved or issued from July 1, 2025 and take effect before March 1, 2027, then the corresponding provisions in this Circular cease to be effective at the time such legal documents take effect.

Authority to perform state management tasks of local authorities at 2 levels with teachers and managers of educational institutions
On June 12, 2025, the Ministry of Education and Training issued Circular 12/2025/TT-BGDDT regulating the decentralization, delegation and assignment of authority to perform state management tasks of two-level local authorities in the field of teachers and educational institution managers.
According to this Circular, the authorities exercised by the Department of Education and Training include: Evaluating principals according to the standards for principals of general education institutions; selecting and approving the list of key general education institution managers; selecting and approving key general education institution teachers; evaluating preschool principals; selecting and approving the list of key preschool institution managers; selecting key preschool teachers.
The authorities exercised by the People's Committee at the commune level include: Organizing competitions for excellent teachers and excellent homeroom teachers; organizing competitions for teachers who are excellent leaders of the Ho Chi Minh Young Pioneers Team.
This Circular takes effect from July 1, 2025.

State management authority of two-level local government with general education
The Ministry of Education and Training issued Circular No. 10/2025/TT-BGDDT dated June 12, 2025, regulating the decentralization, delegation and assignment of authority to perform state management tasks of two-level local authorities for general education.
Specifically, regarding the organization of implementation of regulations on school transfer and admission of students to secondary schools: The authority to issue school transfer referrals for secondary schools is exercised by the Chairman of the People's Committee of the commune where the student is going. The authority to receive, introduce to the school of residence, and check the records according to regulations is exercised by the People's Committee of the commune where the student is going. The authority to consider and decide on exceptional cases regarding school transfer time for secondary schools is exercised by the Chairman of the People's Committee of the commune where the student is going.
The contents that the Chairman of the People's Committee at the commune level has the authority to implement include: Establishing primary schools, secondary schools and general schools with multiple levels of education with the highest level of secondary school being private type as prescribed in Circular No. 40/2021/TT-BGDDT dated December 30, 2021; recognizing the school council and chairman of the school council for primary schools, secondary schools and general schools with multiple levels of education with the highest level of secondary school being private type as prescribed in Circular No. 40/2021/TT-BGDDT;
Recognize principals and vice principals of primary schools, secondary schools and multi-level general schools with the highest level being private secondary schools; establish a Council for considering and recognizing secondary school graduation, decide on graduation recognition, announce the list of students recognized as graduating from secondary schools, and organize the issuance of graduation certificates to students recognized as graduating.
The contents implemented by the People's Committee at the commune level are related to: Organizing the implementation of regulations on inclusive education for children in difficult circumstances; managing and organizing the payment of scholarships and supporting the cost of purchasing means and learning materials for the disabled according to Joint Circular No. 42/2013/TTLT-BGDĐT-BLĐTBXH-BTC; directing schools in the same area to accept and hand over student education results; organizing the implementation of primary school student assessment in the area; directing principals to organize the implementation of assessment, acceptance, hand over education results and monitor, inspect, and resolve difficulties and problems in the process of implementing primary school student assessment.
The People's Committee at the commune level also has the authority to: Direct the organization of the assessment of secondary school students; direct and guide educational institutions to use student monitoring and assessment books (by class), student monitoring and assessment numbers (of teachers), student report cards; guide the use of electronic records; inspect and resolve problems in the process of implementing regulations on assessment of secondary school students;
Authority to manage primary schools and perform state management functions on education for all types of primary schools and classes; management of secondary schools and general schools with multiple levels of education, the highest level of which is secondary school; authority to manage semi-boarding schools for ethnic minorities; authority to manage secondary boarding schools for ethnic minorities; implementation of regulations on management and organization of online teaching and learning in general education institutions and continuing education institutions;
Authority to manage primary schools, secondary schools and general schools with multiple levels of education, the highest level of which is private secondary school, as prescribed in Circular No. 40/2021/TT-BGDDT; authority to develop plans to implement the organization of Vietnamese language teaching for ethnic minority children before entering first grade; advise the provincial People's Committee to develop plans to invest in facilities, resources and funding to ensure conditions for organizing Vietnamese language teaching for ethnic minority children before entering first grade; review textbook selection records of primary and secondary education institutions; consider recognition of secondary school graduation.
The authority to guide, inspect, and manage the organization of teaching and education of students with disabilities (for both public and private types); arrange staffing and funding for recruitment, contracts of teachers and civil servants for other job positions, contract labor, and investment in facilities (for public types) of schools with remaining specialized education classes as prescribed in Articles 28 and 29 of Circular No. 27/2024/TT-BGDDT shall be implemented by the People's Committee at the commune level.
Authority to manage extra teaching and learning activities in the area; guide and inspect the implementation of regulations on extra teaching and learning in the area; handle or recommend to competent authorities to handle violations; monitor and inspect compliance with legal regulations on working hours, overtime and legal regulations on security, order, safety, environmental sanitation, fire prevention and fighting of organizations and individuals providing extra teaching and learning outside of school, implemented by the People's Committee at the commune level.
The authority to establish the Junior High School Admission Council, approve the Junior High School Admission Plan, and approve the list of successful candidates (except for junior high schools affiliated with universities, colleges, and research institutes) is exercised by the Chairman of the Commune People's Committee. The authority to direct and manage the Junior High School Admissions is exercised by the Commune People's Committee.
Authority to guide, inspect, and manage the organization of teaching and education for students with disabilities (for both public and private types); arrange staffing and funding for recruitment, contracts with teachers and civil servants for other job positions, contract labor, and investment in facilities (for public types) of: Specialized education schools, schools with Specialized Education Classes at high school level or Specialized Education Classes studying regular high school education programs implemented by the Provincial People's Committee.
This Circular takes effect from July 1, 2025. This Circular ceases to be effective from March 1, 2027. In case the Law, Resolution of the National Assembly, Ordinance, Resolution of the National Assembly Standing Committee, Decree, Resolution of the Government, Decision of the Prime Minister, Circular of the Minister of Education and Training have provisions on the authority, responsibility for state management, order and procedures prescribed in this Circular which are adopted or issued from July 1, 2025 and take effect before March 1, 2027, the corresponding provisions in this Circular cease to be effective at the time such legal documents take effect.
During the effective period of the provisions of this Circular, if the provisions on authority, state management responsibilities, order and procedures in this Circular are different from relevant legal documents issued before July 1, 2025, the provisions of this Circular shall apply.

The Ministry of Education and Training issued Circular 11/2025/TT-BGDDT regulating the decentralization, delegation and assignment of authority to perform state management tasks of two-level local authorities for vocational education and continuing education.
According to this Circular, the authorities for the People's Committee at the commune level include: Managing the use of diploma and certificate blanks and being responsible for the issuance of diplomas and certificates; organizing the reception and examination of external assessment registration dossiers, sending accepted external assessment registration dossiers to the Department of Education and Training for primary schools; organizing the implementation of regulations on educational quality assessment and recognition of national standards for primary schools;
