Commune level after merger: More rights, greater responsibilities

From July 1, the Law on Organization of Local Government 2025 will take effect, operating a two-level local government model (provincial and communal levels), placing communal authorities in a key position, directly serving and solving essential problems of the people.

On the afternoon of July 3, the An Dong Ward Public Administration Service Center, Ho Chi Minh City, was crowded with people coming to do procedures for notarization, authentication, household registration excerpts, business registration, etc.

Formerly a one-stop shop for the People's Committee of District 5, the space inside the center is quite spacious, with air conditioning, drinking water and candy for people to use while waiting. As soon as the door opens, people will immediately see a kiosk to dial the number to choose the procedure they need to do, or ask the civil servant sitting at the information desk for answers.

Mr. Vo Thanh Toi, Deputy Director of the An Dong Ward Public Administration Service Center, said that the center has arranged 15 counters, of which 2 are for the fields of notarization - authentication, justice - civil status and meritorious people - social protection. In addition, there are 2 counters of the Land Registration Office branch and 1 counter of the Social Insurance to connect documents, helping people not to have to go to many places. Mr. Toi said that in the first 3 days of operating the apparatus according to the 2-level local government model, the number of documents was quite large because the ward was merged from 3 old wards, with a population of more than 80,000 people. "There were people who came to make 20 copies of their birth certificates, wanting the documents to be signed on July 1 because they saw this as a special milestone," Mr. Toi shared.

The two-level model with broader powers and clearer responsibilities of the People's Council and People's Committee at the commune level, along with the mechanism of budget transparency, digital transformation, citizen reception, and receiving questions, all create a grassroots administration that is close to the people, close to the people, and truly serves the people.

According to Thanh Nien reporters' observations at many public administrative service centers, despite the large number of documents, civil servants provided enthusiastic guidance and the general mood of the people was quite comfortable and happy.

Mr. Huynh Van Hoang, Deputy Director of Nha Be Commune Public Administration Service Center, said that the center handled 368 procedures issued by the Ho Chi Minh City People's Committee. In the first 3 days, the center welcomed hundreds of people coming to do the procedures, on July 1, it was more than 500 people. The reason is that Nha Be commune receives administrative procedures for 4 communes combined, besides, some people wait until July 1, when the new government apparatus is put into operation, to do administrative procedures more easily and smoothly. Nha Be Commune Public Administration Service Center arranged 2 teams, 1 team to receive documents directly and 1 team to support people to carry out procedures on the National Public Service Portal to reduce the load.

In addition to being satisfied with the service style at the public administrative center, people are also concerned about the functions and authority of the People's Committee at the commune level according to the 2-level local government model, a model applied for the first time in Vietnam.

The level of government closest to the people

After merging administrative units, from July 1, the whole country has 34 provinces and centrally run cities with 3,321 commune-level administrative units, including 2,621 communes, 687 wards and 13 special zones.

These are the levels of government closest to the daily lives of the people, directly implementing and resolving administrative procedures such as birth registration, death certificates, and contract authentication. This is also the place to organize vaccinations, prevent epidemics, protect security and order, maintain village and hamlet conventions; at the same time, it is also the closest level when people need relief, social security, poverty reduction, care for children, the elderly, and people with disabilities...

Local government at the commune level is streamlined, focusing on efficiency and effectiveness. The People's Council (PC) at the commune level is the state power agency that decides important issues at the grassroots level. The People's Committee (PC) at the commune level, elected by the People's Council at the same level, is the administrative agency responsible for organizing the implementation of the Constitution and laws.

Stronger and clearer duties and powers

The People's Council at the commune level not only performs the tasks according to the Law on Organization of Local Government in 2025 but also receives, determines authority, decentralizes, and delegates power from higher levels according to newly issued decrees.

The People's Council at the commune level decides on most important local issues, from building and approving socio-economic development plans, deciding on budget estimates, allocating and approving budget settlements, passing policies to support agriculture , environmental protection, care for education, health care, culture, to decisions on local national security and defense.

For example, in the financial sector, the People's Council at the commune level decides on national target programs in the area; in land management, it approves the land use plan at its level; in education, it approves the local education development plan. In particular, the People's Council at the commune level also decides on measures to develop digital government, digital economy , digital society, and promote strong digital transformation.

The special new point of the Law on Organization of Local Government in 2025 lies in stronger decentralization and delegation of power. A series of decrees guiding the implementation issued together have transferred to the commune-level authorities many tasks that were previously assigned to the district level.

In the financial field, the People's Council at the commune level will decide on budget allocation, approve budget settlement, and decide on measures to mobilize contributions from the people to build welfare works.

In the field ofeducation , the People's Council of the commune will approve the plan to develop the school network and determine training targets in its area.

In the environmental field, the People's Council at the commune level is assigned to approve plans for payment of forest environmental services, decide on measures to prevent pollution and protect water resources.

Meanwhile, the People's Committee at the commune level, headed by the Chairman of the People's Committee, is responsible for organizing the implementation of the Constitution, laws, resolutions of the People's Council and operating all administrative management activities at the commune, ward and special zone. The People's Committee at the commune level will be responsible for the entire implementation, reporting the implementation results, and explaining to the People's Council and the people.

Streamlined organization, promoting supervision and transparency

To ensure compactness but still have the ability to make decisions and supervise, the structure of the People's Council at the commune level is clearly defined. The Standing Committee of the People's Council at the commune level includes the Chairman, Vice Chairman, Head of the Economic - Budget Committee and Head of the Cultural - Social Committee.

The two specialized committees will, on behalf of the People's Council, examine issues within their areas and make reports for the People's Council to consider and decide. In particular, the standing members of the People's Council cannot concurrently hold the position of People's Committee to ensure independent supervision.

The People's Committee at the commune level also has a more streamlined apparatus, but the Chairman of the People's Committee still has to "take on" a huge amount of work, directly managing everything from land management, resources, construction investment, to coordinating grassroots health care activities, education, maintaining security and order, and reconciling conflicts in the community. The People's Committee also has the task of organizing dialogue conferences with the people, publicizing the budget, and making public spending, bidding, and procurement transparent.

The Law on Organization of Local Government 2025 creates a clear legal corridor for voters to participate in monitoring and inspecting government activities. People's Councils must organize meetings with voters, People's Council deputies must meet with citizens, receive and handle complaints, denunciations and recommendations according to the law. This is a specific legal mechanism to ensure that "government is close to the people, serves the people" is put into practice.

Promoting digital government, digital economy, digital society at the commune level

According to Article 4 of the Law on Organization of Local Government 2025, commune-level governments must "be organized in a streamlined, efficient, effective manner, and effectively apply information technology and digital transformation in organization and operation".

In particular, the People's Committee at the commune level must develop online public services, build a database of population, land, health, and social security, connect with the provincial and central information systems to serve people transparently, reduce time, costs, and travel effort. The People's Council is also encouraged to hold meetings and collect voters' opinions via digital platforms, expand channels for receiving online feedback, and increase interaction.

This is a drastic step, helping the commune-level government not only be a "paper government" but also move towards a "digital government", serving people quickly and transparently.
