The Ministry of Finance has just sent a report to the Government after examining the contractor selection process for the construction package for the section through Binh Phuoc province, part of the Ho Chi Minh City - Thu Dau Mot - Chon Thanh expressway project, invested by the Binh Phuoc Provincial Construction Investment Project Management Board.
This bid package has an estimated cost of more than VND880 billion, part of a project with a total investment of VND1,474 billion for a 7km section through Binh Phuoc.
After the bid opening on March 17, the Truong Son - Thanh Phat joint venture was selected with a winning bid price of VND 845.4 billion, saving more than VND 35 billion compared to the estimate.
However, the remaining four bidders, including Son Hai Group Company Limited (Son Hai Group) - the bidder with the lowest price (over 732 billion VND), were eliminated due to failing to meet technical requirements.
The investor said that Son Hai did not meet the requirements for materials and equipment; did not meet the requirements for organizing the implementation of building information modeling (BIM) and did not meet the requirements for machinery and equipment for construction.

After reviewing the documents, the Ministry of Finance assessed that the application of the BIM model in the construction phase was appropriate. However, the Ministry emphasized that the investor must be responsible for determining the BIM evaluation criteria to ensure clarity, transparency, feasibility, and avoid different interpretations among contractors.
Regarding the assessment of construction machinery and equipment, the Ministry believes that the assessment of related documents requires further reference to regulations and opinions from specialized agencies. Therefore, the Ministry does not have enough basis to conclude on the legality of technical inspection certificates provided by contractors.
Regarding the expert team evaluating the dossier, the Ministry of Finance confirmed that all three members have practice certificates, valid until at least October 2028. However, the responsibility for ensuring the capacity and experience of the expert team belongs to the investor.
Notably, the Ministry of Finance discovered that there was an inconsistency in the evaluation between the detailed report and the summary report for 4/5 of the eliminated contractors. While the detailed report evaluated the capacity and experience as “failed”, the summary report evaluated it as “passed”.
In addition, according to the provisions of Chapter III of Construction Form No. 3A, the request for the contractor to replace non-compliant equipment must be made in the step of evaluating capacity and experience, but the expert team/inviting party does it in the technical evaluation section.
From the above shortcomings, the Ministry of Finance recommends that the Government leaders request Binh Phuoc province to study the above contents, thereby deciding and taking full responsibility for the selection of contractors for the above construction package.
The Ministry also requested that localities promptly consider and resolve Son Hai Group's petition in accordance with regulations, not to prolong it, and at the same time ensure the selection of contractors with sufficient capacity, experience and finance to implement on schedule and with quality, avoiding loss, waste and negativity.
If necessary, localities can coordinate with relevant ministries and branches to clarify the legality of technical inspection and environmental protection documents... related to the bid package.
Previously, Son Hai Group, one of the five bidders, submitted a petition disagreeing with the disqualification result, despite offering the lowest price.
The Ho Chi Minh City - Thu Dau Mot - Chon Thanh Expressway construction project passes through Ho Chi Minh City (about 2km of access road), Binh Duong province (52km long) and Binh Phuoc province (7km long). The section through Binh Phuoc province was started in December 2024.
