The separation of people's overlapping land with forestry land is being considered and resolved.

Recently, farmers in the upstream area of ​​Hoa Son Lake (Tu Bong Commune) and Son Tan area (Cam Hiep Commune) have petitioned the province to consider separating overlapping land with the management boards of protective forests to ensure production and stabilize their lives.

Following the trails that have now been paved with concrete by local people from the edge of Hoa Son Lake to the production areas: Dap Da, Da Than, Suoi So, Suoi Sung, Co Co, Da Trai, Doc De (upstream of Hoa Son Lake, Tu Bong Commune)... are banana gardens, interspersed with durian, mango, avocado, rambutan gardens... of local people. Along the way to the fields, we occasionally met farmers riding motorbikes carrying agricultural products down the mountain to sell.

Visiting the garden of Mr. Dinh Van Thien's family in Long Hoa village, we were taken to see the garden with 150 durian trees, hundreds of mango and jackfruit trees intercropped with bananas. Mr. Thien said that his family had reclaimed the 3ha garden in the Da Than area since the 1980s, initially mainly growing corn and cassava, then gradually converted to growing cashews and fruit trees. His family has been cultivating this entire area continuously since then. Currently, his family's main source of income depends entirely on the garden in Da Than. He hopes that the fruit trees and this garden will help change his family's life. Although he has been cultivating this area for many years, up to now, his family's garden land has not been granted a land use right certificate because it overlaps with the area of ​​the Bac Khanh Hoa Protective Forest Management Board. This has caused difficulties for his family, such as after storm No. 12 in 2017, when all the trees in the garden were broken, he wanted to borrow money to rebuild the garden but could not mortgage it to borrow money. Not only his family, in the upstream area of ​​Hoa Son Lake, there are hundreds of hectares of people's production land overlapping with the forest area of ​​the Management Board of Bac Khanh Hoa Protective Forest.

Similarly, hundreds of plots of land belonging to people in Son Tan area (Cam Hiep commune) are also overlapping the forest area of ​​the Management Board of Nam Khanh Hoa Protective Forest. Mr. Tro Xoai (in Suoi Coc village) recalls that before 1995, his family lived in the Cam Ranh Thuong lake area. When this reservoir was built, his family was relocated and settled in Suoi Coc village from 1999 to present. The entire house and the land area of ​​about 5 hectares where his family is growing cashew trees here overlap with the forest area of ​​the Management Board of Nam Khanh Hoa Protective Forest, so the procedures for land division, transfer, etc. cannot be carried out. This greatly affects his family's land use rights.

Not only Mr. Tro Xoai's family, in the old Son Tan commune area, there are about 150 households that have been granted land use right certificates, but because of overlapping with forest land managed by the Nam Khanh Hoa Protective Forest Management Board, households cannot separate plots, give them away, or give them to their children. In addition, some poor households have not been granted red books because of overlapping land, affecting their rights when there are policies to support the poor.

Mr. Ngo Cong Chau - Deputy Director of the Management Board of Nam Khanh Hoa Protective Forest said: Since 2022, the Management Board has coordinated with the consulting unit to carry out the work of establishing land use boundary records; measuring and correcting cadastral maps; establishing cadastral records, issuing land use right certificates and building cadastral databases for forest management boards according to the decision of the Provincial People's Committee. By August 2024, the consulting unit had completed the work of determining boundaries, setting up markers, measuring and correcting cadastral maps for the forest areas assigned to the Management Board of Nam Khanh Hoa Protective Forest for management and use. The Management Board has continued to inspect and review statistics of areas that people have cultivated for many years, as a basis for providing information to make proposals for separation when developing land use plans for the Management Board of Nam Khanh Hoa Protective Forest.

Likewise, the leader of the Management Board of Bac Khanh Hoa Protective Forest also affirmed: The production forest land of the people in the upstream area of ​​Hoa Son Lake is overlapping with the protective forest land managed by the Management Board of Bac Khanh Hoa Protective Forest. Currently, the Management Board is coordinating with relevant agencies, departments and branches to review and complete the Management Board's land use plan in accordance with regulations; recommending that competent authorities have a policy to allow separation and grant land use right certificates so that people can confidently invest in economic development.

Regarding the petition of the people of Tu Bong and Cam Hiep communes on reviewing and separating the area of ​​cultivated land of the people overlapping with the management area of ​​the protection forest management boards; granting land use right certificates for eligible plots of land, the Provincial People's Committee has recently issued an official dispatch responding to this issue. structured, the protection forest management boards are coordinated with relevant agencies to review and develop land use plans of the forest management boards, on that basis, carry out the registration and declaration, grant land use right certificates for plots of land under the forest management boards and separate and hand over to the locality the overlapping area for consideration of granting land use right certificates to the people for eligible plots of land. However, due to the complicated origin of the overlapping land between the people and the forest management boards, which has been going on for many periods, the Provincial People's Committee is continuing to direct the Department of Agriculture and Environment to urge relevant units to speed up the completion of the land use plan of the forest management boards to serve as a basis for considering and resolving people's petitions on the separation of overlapping land in the above areas.
