The kickstand is used to fix the position of the vehicle when parking, but even when driving a motorbike, many people still forget to put down the kickstand.

This is a very common mistake of motorcyclists. Forgetting to put down the kickstand while the vehicle is running can lead to collisions with the road surface and damage to road infrastructure.

Clause 1, Article 8 of the 2008 Law on Road Traffic strictly prohibits the following acts: "Destroying roads, bridges, tunnels, ferry terminals, traffic lights, markers, signs, convex mirrors, median strips, drainage systems and other works and equipment belonging to road traffic infrastructure".

Therefore, if you forget to put down the kickstand and it scrapes against the road, it can be considered an act of vandalism to the road or traffic bridge.

In particular, forgetting to put down the kickstand is potentially dangerous not only for the motorcyclist but can easily cause traffic accidents that affect the lives and health of other road users.

Regarding the penalty level, Point a, Clause 6, Article 6 of Decree 100/2019/ND-CP dated December 30, 2019 of the Government on administrative sanctions for violations in the field of road and railway traffic, stipulates the specific penalty level as follows:

"Article 6. Penalties for drivers of motorbikes, mopeds (including electric motorbikes), vehicles similar to motorbikes and vehicles similar to motorbikes violating road traffic rules

6. A fine of VND 2,000,000 to VND 3,000,000 shall be imposed on a driver who commits one of the following violations:

a) Using a kickstand or other object to scrape the road while the vehicle is running.

Accordingly, if the kickstand is left on the road while the vehicle is running, the driver of a motorbike (including an electric motorbike) can be fined up to 3,000,000 VND.

In particular, according to Point c, Clause 10 of this Article, the above behavior may also result in the revocation of the driver's license for 02 - 04 months.

It should be noted that, in reality, the penalty is applied to the act of intentionally using a kickstand or other object to scrape the road with a specific purpose (such as intentionally creating sounds or sparks from racing groups, weaving, swerving, etc.).

In the case of people forgetting to put down the kickstand, this is just an unintentional mistake, not a case of "using the kickstand to scrape the road while the vehicle is running", usually the traffic police only remind but do not impose a fine.

Nowadays, scooters are often equipped with a warning system that if the driver has not put down the kickstand, the vehicle will not be able to accelerate. This will ensure the safety of traffic participants. As for manual transmission vehicles, there is no such system, so the driver can still forget to put down the kickstand while driving.
