Amending regulations on inland waterway vehicle registration agencies

(Chinhphu.vn) - The Ministry of Construction issued Circular No. 09/2025/TT-BXD amending and supplementing a number of articles of Circulars under the state management of the Ministry of Construction related to the arrangement of organizational apparatus, implementation of two-level local government and decentralization to local government.

Ministry of Construction amends regulations on inland waterway vehicle registration agencies

Circular No. 09/2025/TT-BXD amends and supplements a number of articles of Circular No. 75/2014/TT-BGTVT dated December 19, 2014 of the Minister of Transport regulating the registration of inland waterway vehicles (amended and supplemented by Circular No. 35/2020/TT-BGTVT dated December 23, 2020 of the Minister of Transport amending and supplementing a number of articles of the Circulars regulating the periodic reporting regime in the field of inland waterways and Circular No. 60/2024/TT-BGTVT dated December 17, 2024 of the Minister of Transport amending and supplementing a number of articles of the Circulars regulating the registration of inland waterway vehicles and regulations on examination, testing, issuance, re-issuance, and conversion of certificates of professional competence, professional certificates of crew members, and persons inland waterway vehicle driver

Accordingly, the agency registering inland waterway vehicles is regulated as follows: 1- The Department of Construction shall register vehicles with VR-SB license, non-motorized vehicles with a total tonnage of over 15 tons, motorized vehicles with a total main engine capacity of over 15 horsepower, and vehicles with a capacity of over 12 people of organizations and individuals with headquarters or permanent residence registration in that province or centrally-run city.

2- The People's Committee at the commune level shall register non-motorized vehicles with a total tonnage of 01 ton to 15 tons or a capacity of 05 to 12 people, motorized vehicles with a total main engine capacity of up to 15 horsepower or a capacity of up to 12 people of organizations and individuals with headquarters or permanent residence registration in the management area.

The People's Committee at the commune level shall organize the management of rudimentary vehicles with a total tonnage of less than 01 ton or a capacity of less than 05 people or rafts when operating on inland waterways and must ensure safety conditions according to regulations.

The Circular clearly states that the registration agency specified in Clause 1 is responsible for organizing and implementing vehicle registration specified in Clause 2 above.

Management of waterway transport routes from shore to island in Vietnam's sea area

Circular No. 09/2025/TT-BXD also amends and supplements a number of articles of Circular No. 16/2013/TT-BGTVT dated July 30, 2013 of the Minister of Transport regulating the management of waterway transport routes from shore to islands in Vietnam's sea areas (amended and supplemented by Circular No. 24/2022/TT-BGTVT dated October 13, 2022 of the Minister of Transport amending and supplementing Circulars of the Minister of Transport regulating the management of waterway transport routes from shore to islands in Vietnam's sea areas and Circular No. 10/2024/TT-BGTVT dated April 10, 2024 of the Minister of Transport amending and supplementing a number of articles of Circulars regulating the management of waterway transport routes from shore to islands in Vietnam's sea areas).

Accordingly, the responsibility for announcing and managing the waterway transport route from shore to island is stipulated as follows:

Regarding the announcement of waterway transport routes from shore to island, the Provincial People's Committee organizes the announcement of waterway transport routes from shore to island for routes within the administrative boundaries managed by that locality. In case the waterway transport route from shore to island passes through the administrative boundaries of two or more provinces, the relevant Provincial People's Committees are responsible for coordinating and reaching a written agreement to determine a Provincial People's Committee to carry out the announcement of the route. The selection of the Provincial People's Committee to carry out the announcement of the route is based on one of the following criteria: the location of the starting point of the route is within the province; the length of the route is within the administrative boundaries of that province or a written agreement between the relevant Provincial People's Committees.

For the waterway transport routes from shore to island specified in Appendix I attached to this Circular (Hai Ha - Tran Island - Co To route; Hai Phong - Bach Long Vi; Cua Viet - Con Co; Da Nang - Hoang Sa; Sa Ky - Ly Son; Khanh Hoa - Truong Sa; Nha Trang - Hon Noi; Phan Thiet - Phu Quy; Vung Tau - Con Dao; Ho Chi Minh City - Con Dao ...), the Provincial People's Committee is responsible for organizing the review and re-announcement to ensure completion before December 31, 2025.

The provincial People's Committee shall announce the waterway transport route from shore to island and send a written notice to the Vietnam Maritime and Waterways Administration to serve the state management of maritime and inland waterways.

Responsibility for managing the waterway from shore to island

According to the Circular, the organization and management of water transport activities on water transport routes from shore to islands in Vietnam's sea areas is carried out in accordance with the provisions of the law on maritime and inland waterway traffic.

The Vietnam Maritime and Waterways Administration organizes inspections and guides the implementation and compliance with legal regulations on maritime and inland waterways for announced waterway transport routes from shore to islands.

This Circular takes effect from July 1, 2025./.
