At the meeting, explaining the acceptance and revision of the draft Law on Prevention and Combat of Human Trafficking (amended), Ms. Le Thi Nga, Chairwoman of the National Assembly 's Judicial Committee, said that some opinions suggested adding the act of "agreeing to buy and sell human beings while they are still fetuses" to the concept of human trafficking in Clause 1, Article 2 as a basis for effectively combating and preventing the current situation of agreements to buy and sell human beings while they are still fetuses.

In addition, according to Ms. Nga, there is a concern that in practice, there is a situation where an agreement to buy and sell a fetus in the womb is made to raise the child after birth. Is this considered human trafficking?

Regarding the above issue, the Standing Committee of the National Assembly expressed its opinion that: Through reviewing the provisions of relevant laws, in some cases, civil rights can only be established after a person is born and alive. According to the provisions of the Penal Code, committing a crime against a pregnant woman is only considered an aggravating circumstance and not considered a crime against many people. Thus, legally, a person is only considered a human being when born and alive. According to medicine, a fetus is not yet determined to be a human being. Clause 1, Article 2 of the draft Law stipulates the concept of human trafficking, while a fetus has not been determined to be a human being as analyzed above, so the Standing Committee of the National Assembly believes that the regulation of fetal trafficking in the concept of human trafficking is inappropriate.

“However, in recent years, the situation of buying and selling fetuses for the purpose of buying and selling children after birth is a worrying reality. This agreement to buy and sell is essentially a premise for human trafficking, human trafficking from the fetal stage, but the handling of this behavior has not been regulated by law. In response to the requirement to improve the effectiveness of measures to prevent human trafficking early and from afar. At the same time, creating a legal basis to continue perfecting the law on handling violations related to women and children, accepting the opinions of National Assembly Deputies, Clause 2, Article 3 of the draft Law has stipulated the prohibited act of “agreeing to buy and sell people from the fetal stage”.

Agreeing with the viewpoint of the National Assembly Standing Committee, Deputy Thach Phuoc Binh ( Tra Vinh Delegation) said that it is necessary to prevent human trafficking agreements from the time they are still fetuses. At the same time, it is necessary to prevent the exploitation of victims to force and coerce them into labor to produce online pornographic content today. In addition, the Law needs to have policies to support victims of human trafficking to study culture and learn a trade to integrate well into the new environment in order to integrate into life.

Delegate Thai Thi An Chung (Nghe An Delegation ) proposed to prevent human trafficking from the fetus stage, because in reality, there are cases of ethnic minorities being lured to go abroad to give birth, then buying and selling the children.

“This is a form of buying and selling fetuses and is very difficult to prevent. Therefore, the draft law regulating the prohibition of agreements to buy and sell people while they are still fetuses is very necessary. It is necessary to prohibit the buying and selling of fetuses to prevent human trafficking,” said Ms. Chung.

Referring to the fact that in recent years, the situation of buying and selling fetuses for the purpose of buying and selling children after birth is a worrying reality. This buying and selling agreement is essentially a premise for human trafficking, human trafficking from the fetal stage, but the handling of this behavior has not been regulated by law, Deputy Duong Khac Mai (Dak Nong Delegation) said that the draft Law strictly prohibiting agreements to buy and sell people from the fetal stage shows progress, contributing to preventing human trafficking.
