Disney fined $10 million for not labeling YouTube as 'Made for Kids'

Walt Disney will pay $10 million to settle allegations that it allowed the unauthorized collection of personal data of children watching children's videos on YouTube without their knowledge.

On September 2, the US Federal Trade Commission (FTC) said that Walt Disney Corporation will have to pay $10 million to settle allegations that the company allowed the unauthorized collection of personal data of children watching children's videos on YouTube without notifying or asking for parental permission.

According to the FTC, Disney failed to label some YouTube videos as “made for kids” when they were posted to the platform.

This mislabeling allowed Disney, through YouTube, to collect personal data from children under the age of 13 when viewing children's videos and use that data for targeted advertising.

The FTC said this violated the US Children's Online Privacy Protection Act (COPPA).

Under COPPA, websites, apps, and online services intended for children under 13 must notify parents about the personal information they collect and obtain informed consent from parents before doing so.

Additionally, the settlement order requires Disney to “implement an audience labeling program to ensure videos are properly identified as ‘made for kids’ when appropriate.”

“This agreement does not involve Disney-owned and operated digital platforms, but is limited to the distribution of some of our content on the YouTube platform,” a Disney spokesperson said. “Disney has a long history of adhering to the highest standards of child data protection laws, and we will continue to invest in the tools necessary to remain a leader in this area.”
