While the 2016 Press Law does not have clear regulations for the formation and development of large press agencies with sufficient resources to lead and orient information, and especially does not have regulations on whether a press agency can be directly under another press agency, this draft has added the concept of "Multimedia key press and communication group".
This is the operating model of a press agency with many types of press, with affiliated press agencies, affiliated enterprises or capital contributions in enterprises. This model plays a core role in orienting public opinion and will be applied with specific mechanisms on finance, labor, and wages like enterprises. This model is consistent with the planning for the development of the network of press, radio, television, electronic information, and publishing establishments approved by the Prime Minister .
In addition, the draft also adds the concept of “Local Press Group”. This is the operating model of a local press agency with many types of press, with affiliated press agencies, playing a core role in orienting public opinion in the locality. The Government is assigned to specify specific mechanisms on finance, labor, and salary for “Key multimedia press groups”, as well as the operating model of “Local press groups”.
Another noteworthy content in the draft is that it clearly distinguishes between newspapers and magazines, and at the same time more strictly manages information activities in cyberspace. Accordingly, a general electronic information page is not a journalistic information product (journalistic information products only include newsletters and special issues).
The draft also adds two prohibited acts related to the operation of general electronic information sites and social networks, as well as foreign information activities. Specifically, it is strictly forbidden for organizations and enterprises providing social network services and general electronic information sites to self-produce and post and broadcast news and articles like press agencies; it is strictly forbidden for information that negatively affects the position, reputation and image of Vietnam, and harms foreign relations and international cooperation between Vietnam and other countries and partners.
According to the National Assembly 's law-making program, this bill will be submitted to the National Assembly for comments and consideration and approval at the 10th session (next October).
