Veteran charged with manslaughter after choking black man

Former US Marine Penny has been charged with manslaughter by Manhattan prosecutors after choking a black man to death.

Daniel Penny, 24, turned himself in at a Manhattan police station on May 12. Thomas Kenniff, one of Penny's attorneys, said the former US Marine turned himself in "voluntarily and with the dignity and integrity that characterized his military service and service to his country."

Earlier, Manhattan District Attorney's Office in New York charged veteran Penny with manslaughter on May 11 for choking black man Jordan Neely to death on a train earlier this month. Penny faces a maximum sentence of 15 years in prison.

Penny’s attorneys said their client did not anticipate Neely’s death when he put the black man in a chokehold. They argued that Penny acted in self-defense before police arrived, noting Neely’s history of violence and erratic behavior, 30.

Witnesses and police said Penny intervened as Neely yelled, threatened and threw trash at passengers while asking for money. Neely was unconscious when he reached the Broadway-Lafayette St stop and was taken to Lenox Hill Hospital, where he was pronounced dead from a chokehold.

Penny served in the Marine Corps from 2017 to 2021. US Marines are trained in chokeholds that can render an opponent unconscious in as little as eight seconds. However, Penny held Neely for at least three minutes.
