Specifying the State Budget Law towards increasing decentralization and delegation of power

(Chinhphu.vn) - The draft Decree guiding the implementation of the State Budget Law 2025 is being completed by the Ministry of Finance, with many new regulations to create flexible and timely conditions for localities to handle arising issues and promote decentralization.

Increase positivity, practicality and promote development

On July 7, the Ministry of Finance held a national conference to solicit opinions on the draft Decree detailing the implementation of a number of articles of the State Budget Law 2025 to be submitted to the Government. This draft aims to replace Decree No. 163/2016/ND-CP, with many major amendments to meet practical requirements, especially in the context of the two-level local government model being widely deployed.

Speaking at the conference, Deputy Minister of Finance Nguyen Duc Chi emphasized that the State Budget Law No. 89/2025/QH15 is an important law with a wide scope of regulation, affecting all sectors, all levels and localities across the country. The law was passed by the National Assembly on June 25, 2025 with a high consensus rate, demonstrating consensus in reforming and improving the effectiveness of budget management.

Since the Law was under consideration by the National Assembly, the Ministry of Finance has proactively prepared a draft guiding decree and sent it to ministries, branches and localities for comments. The Ministry also posted the draft on the electronic information portal to solicit public comments. After the Law was passed, the Ministry promptly received and revised the comments, continuing to complete the draft to solicit comments at this conference.

Deputy Minister Nguyen Duc Chi said that the draft was built on the basis of five major guiding principles. These are: ensuring consistency with the principles of amending the Law; only detail what the Law has assigned; maintaining the stability and consistency of the legal system; inheriting current regulations to promote effectiveness; and finally, simplifying procedures, increasing considerations, strongly decentralizing and promoting the responsibility of the head.

Delegates at the conference assessed that the draft has thoroughly revised the old concerns, especially in decentralization and budget support. The new regulation allows the use of advance funds and determines the repayment time more clearly, contributing to creating flexible conditions for localities to manage the budget, especially when implementing the 2-level local government model, which requires high adaptability in the organization of the apparatus and budget.

"The issuance of the guiding decree is a necessary step to concretize the decentralization policy, creating motivation for all levels, sectors and localities to be more proactive in budget management - one of the key tools to achieve socio-economic development goals," Deputy Minister Nguyen Duc Chi emphasized.

Promote decentralization, reduce procedures, increase initiative

According to Mr. Nguyen Minh Tan, Deputy Director of the State Budget Department (Ministry of Finance), the draft decree focuses on solving 3 key groups of issues, considering the 3 pillars of the new budget management mechanism.

First, perfecting the budget cycle and overcoming existing problems. This is a comprehensive content, related to the entire budget life cycle, from budget preparation, implementation, settlement to publicity.

Second, to untie development investment and strengthen regional connectivity. The Decree will clarify the mechanism for localities to use development investment capital from local budgets for key infrastructure construction projects.

Third, standardize the preparation of 5-year financial plans. specifically, to enhance the vision and strategy in financial management, the draft decree will summarize and provide detailed instructions on the preparation of 5-year financial plans.

In addition, some notable points in the draft include: Adding authority to the provincial People's Council to decide on regimes, standards, and norms for local budget expenditures; empowers the Prime Minister to assign revenue and expenditure estimates to ministries, branches, and localities; regulating the handling of budget surpluses; as well as the procedure for supporting lower-level budgets when there is a revenue shortfall due to objective factors.

This year's draft decree clearly demonstrates a strong spirit of decentralization and reduces cumbersome administrative procedures. In particular, the draft has abolished a number of old regulations such as: Inspection numbers in the 3-year state budget financial plan; mechanism for deducting expenses when collecting and paying fees to the budget; principle of decentralization of revenue sources - expenditure tasks during the period of budget stabilization.

Regarding budget preparation, the draft clearly requires the responsibilities of agencies, the time frame for preparation, synthesis, decision and allocation of budgets. Regarding budget management, the Ministry of Finance will submit to the Government an adjustment plan in case of adjusting the budgets of central ministries and branches without increasing the deficit. Meanwhile, for local budgets, local financial agencies will develop an adjustment plan, submit it to the People's Committee and report to the People's Council at the same level.

In addition, regulations on closing books, transferring sources, settling accounts, as well as responsibilities and timing of budget disclosure and community supervision are all specified in the draft, aiming to enhance transparency and accountability.

The Decree guiding the implementation of the State Budget Law 2025 is one of six Decrees that the Ministry of Finance is in charge of developing to implement the law. This draft not only helps clarify responsibilities between budget levels, but also helps guide medium-term financial, planning supporting ministries, branches and localities to manage the budget more proactively and effectively.

At the same time, the new regulation will also help increase the ability to respond promptly to problems arising in the context of many socio-economic fluctuations, as well as the requirements to modernize public financial management in the digital transformation era.

The Ministry of Finance leader said that from now until the official submission to the Government for promulgation, the Ministry of Finance will continue to collect comments from ministries, sectors and localities. The comments will contribute to perfecting the budget legal framework - a key pillar to ensure effective national governance and sustainable development.
