Member of the Party Central Committee, Vice Chairman of the National Assembly Le Minh Hoan - Head of the supervision delegation, chaired the meeting.

At the meeting, members of the delegation raised a number of questions requesting the Ministry of Justice to clarify many contents in perfecting policies and laws on environmental protection; implementation work; and results of reviewing the legal system on environmental protection.
Reporting to the monitoring delegation, Deputy Minister of Justice Nguyen Thanh Tu said that the Law on Environmental Protection 2020 assigned the Government, the Prime Minister, ministries and ministerial-level agencies to develop and promulgate 9 detailed regulations. These documents have been fully promulgated. The Ministry of Justice's comments and appraisal of projects and draft legal documents in the field of environmental protection ensure progress in terms of time and meet quality requirements.
In general, the system of legal documents on environmental protection is basically comprehensive and in harmony with the legal system on economy and society. Decrees and guiding circulars are developed in accordance with correct procedures; ensuring timeliness, completeness, and specificity, serving as a basis for implementing and managing environmental protection work.
However, there are still 24 contents with difficulties and problems related to the Law on Environmental Protection. Some documents have not been issued in time or have just been issued in 2025. Notably, these are important documents to promote the green energy and green finance transition roadmap in Vietnam; create a complete legal basis for the formation and operation of the domestic carbon market; and at the same time, they are also new and difficult contents.
For example, the draft Decree on domestic carbon trading floors has been appraised by the Ministry of Justice but has not been issued yet. Decision No. 21/2025/QD-TTg of the Prime Minister promulgating environmental criteria and certifying projects granted green credit and green bonds has just been issued, effective from August 22, 2025. The Ministry of Justice has requested the Ministry of Agriculture and Environment to study these problems and make maximum amendments during the process of drafting a law amending 15 laws, which will be submitted to the National Assembly in the near future.
In addition, 31/33 problematic contents in Decree 08/2022/ND-CP detailing a number of articles of the Law on Environmental Protection have been amended in Decree 05/2025/ND-CP; the remaining 2 problematic contents are being amended by the Ministry of Agriculture and Environment.
In his speech, Vice Chairman of the National Assembly Le Minh Hoan requested the Ministry of Justice to proactively study and propose amendments and supplements to the Law on Environmental Protection and other laws, ensuring that law-making is linked to practical requirements and making effective and highly feasible proposals and recommendations.
Along with that, the Ministry of Justice needs to innovate its thinking and orientation in law-making; closely linking law-making and law enforcement. This will contribute to promptly removing new bottlenecks that may arise and be suitable for the new context of two-level local government.
“This is an extremely important issue, deciding the effectiveness and efficiency of state management and law enforcement on environmental protection,” the Vice Chairman of the National Assembly emphasized.
