First US state to pass full ban on TikTok

According to RT , on May 17, the state of Montana issued a comprehensive ban on the video- sharing platform TikTok, which is also the first state in the US to ban this application. TikTok later spoke out against the ban of the Montana state government, saying that this violates the constitutional rights of US citizens.

In a statement on Twitter, Montana Governor Greg Gianforte emphasized that he signed a bill banning TikTok in the state on May 17, stressing that the move was necessary to “protect Montanans’ personal data and privacy from China.”

The ban will take effect on January 1, 2024, but could face legal challenges from both TikTok and civil liberties groups.

Known as SB419, the TikTok ban passed the Montana legislature last month with strong Republican support. Most Montana lawmakers say TikTok poses a privacy and national security threat to the United States.

The bill banning TikTok would only apply in the state of Montana and would prohibit online app stores from allowing users to download the app. In case of violation, the app company could be fined up to $10,000 per day.

After SB419 was signed into law, TikTok said it would fight the new law and “continue to work to protect the rights of its users in and outside of Montana.”

“Governor Gianforte signed a bill that violates the First Amendment rights of Montanans by unlawfully banning TikTok,” TikTok spokesperson Brooke Oberwetter said.

TikTok representatives also reassured Montana users that they can continue to use TikTok to express themselves, get work done, and connect with their communities.”

TikTok has previously repeatedly asserted that its business operations in the US are conducted through its headquarters in the US. At the same time, TikTok has also asserted that there is no such thing as the app transferring user data from the US to China.

According to RT , human rights groups and technology industry organizations in the US also condemned Montana's ban.

While Montana was the first state to impose an outright ban on TikTok, the app has faced restrictions in at least 25 other US states and within the federal government , which has banned the app on government devices.
